Shipment of non hazardous waste

Questionnaire 2012

The European Commission (Directorate General for Trade) sent out a "note verbale" to obtain answers from each one of the countries and territories concerned . Countries were asked to complete 2 questionnaires to indicate their choices regarding shipment of waste and mixtures of wastes for recovery, according to the four column lay-out recommended in the consolidated version of Commission Regulation (EC) 1418/2007.

The questionnaires are in line with Article 37 of Reg. 1013/2006, which stipulates that the European Commission should seek from each country concerned:

  • confirmation in writing that the waste may be exported from the [European] Community for recovery in that country, and
  • an indication as to which control procedure, if any, would be followed in the country of destination.

In the questionnaires, each country may choose among the following 4 options:

  • to prohibit the shipment,
    • or to allow it subject to
  • a procedure of prior written notification and consent,
  • an absence of control in the country of destination
  • any other control procedures that the country of destination applies.

The replies will be reflected in a Regulation  which the European Commission will adopt in 2012 to amend Regulation No1418/2007.

      France did not mention individual exclusion for these territories at the time that it became a member of the OECD.

      Consequently, the applicable arrangement for shipments of non hazardous waste for processing from the European Union towards the French departments and overseas territories is the same as those applicable to the French metropolitan territory.

Liechtenstein

    • Abstract: In response to Commission Note Verbale, Albania sent the following response:
      Liechtenstein is in a custom union with Switzerland and has not requested any different treatment from that applying to Switzerland. Subject to verification, this means that as Switzerland is an OECD Member Country. Liechtenstein will be regarded as requesting no control procedures under regulation 1013/2006 (column 3 of the questionnaire applies to all items).
      With their reply covering the exact position in relation to the customs union, the Liechtenstein authorities also enclosed the copy of the Basel Convention Fact Sheet relating to Liechtenstein.

      Prior approval of the Central Environmental Authority (CEA) is needed to import any item listed in the list B of the Basel Convention.
