Questionnaires

There are two Commission's questionnaires enquiring about non-OECD countries' control procedures for imports of non-hazardous waste:

  • a general questionnaire regarding each type of non-hazardous waste listed in Annex III of Regulation 1013/2006.
  • a questionnaire regarding mixtures of wastes listed in Annex IIIA of Regulation 1013/2006 (The first two mixtures of waste relevant for non-OECD countries were included into Annex IIIA in 2009 on the basis of Regulation (EC) No 308/2009 and eleven more in 2011 on the basis of Regulation (EU) No 661/2011. Consequently this questionnaire was established and submitted to the partner countries for the first time in 2012).

In line with the requirements set by Article 37 of Regulation 1013/2006, the partner countries are asked to indicate which of the following four options for import control procedures they have chosen for each type of non-hazardous waste or mixture of waste concerned:

  1. prohibition of imports;
  2. imports allowed subject to a procedure of prior written notification by the EU Member States from which the exports shall take place and a consent by the importing country as described in Article 35 of Regulation 1013/2006;
  3. imports allowed without any control in the country of destination;
  4. imports allowed subject to other control procedures followed in the country of destination under the applicable national law

A need for that last option appeared only after the reception of the partner countries' responses to the Commission's questionnaire during the preparations of Regulation 1418/2007. Therefore it was included in Regulation 1418/2007 but it is not explicitly mentioned in Article 37 of Regulation 1013/2006.

In case a partner country does not indicate any of the four options for a kind of waste or mixture of waste concerned, in accordance with Article 37 of Regulation 1013/2006 it is presumed that option (b) applies.

  1. Tokelau informed the Commission that as a non self-governing territory of New Zealand, there are no waste imports into Tokelau. For this reason, completing the questionnaire in relation to Tokelau is of no value. This means that in the event that - despite the current state of affairs - any party in Tokelau wished to import from the European Union some raw material which is classified as non-hazardous waste, the procedure of prior written notification and consent would apply, as described in Article 35 of Regulation (EC) 1013/2006.
