The European Commission has requested Spain to take measures to fully apply the EU Directive that establishes basic rules on protecting workers' health and safety to members of the Civil Guard ('Guardia Civil').
The Directive (89/391/EEC) requires Member States to put in place legislation obliging employers and workers to take measures to limit accidents at work and occupational diseases. This Directive also obliges Member States to improve the training, information and consultation of workers as regards health and safety measures.
The problem in Spain is that for certain of the Civil Guard's workplaces no one has been appointed to verify that health and safety prevention measures are put in place. As a result, the health and safety at work of members of the Civil Guard could be at risk.
If Spain does not notify measures to ensure full compliance with its obligations under the Directive within two months, the Commission may decide to refer the case to the EU's Court of Justice.
