Q: What is the legal basis of a Joint Technology Initiative?
A: JTIs are established on the basis of Article 171 of the EC Treaty. This allows the Community to set up Joint Undertakings for the "efficient execution of Community research, technological development and demonstration programmes". Article 172 of the Treaty specifies that Joint Undertakings can be decided by the Council after consulting the European Parliament and the Economic and Social Committee.

JTIs are set up on the basis of a Council Regulation following a proposal from the Commission.
