Article 7 (2) to (4): Formal requirements as to agreements on the choice of applicable law
In the Belgian legislation, there is no specific formal requirement applicable to agreements on the choice of applicable law pursuant to Article 7 (2) to (4) of Regulation (EU) No 1259/2010.
Article 5 (3): Possibility of designating the applicable law
Concerning the requirements for the designation of the applicable law, the Belgian Code of Private International Law provides in article 55 (2).3 that the choice must be exercised at the first appearance (Loi du 16 juillet 2004 portant le Code de droit international privé, Mon. b., 27 juillet 2004, vig. 1er octobre 2004).
