Founding BCR documents
The WP29 adopted the first founding BCR documents in 2003 and 2005:
The Working Paper 74 was the first document adopted which presented BCR.
The Working Paper 107 describes the EU cooperation procedure.
The Working Paper 108 is designed to assist a group of companies when it applies for approval of its binding corporate rules.
Documents useful when drafting BCR
The Working Party has adopted in 2008 several documents which aim at clarifying the commitments companies shall implement when adopting BCR. These documents should be used as a “tool box” when companies draft BCR.
- The Working Paper 154 provides guidance to what the BCR should look like by providing a structure of BCR.
- The Working Paper 153 provides a full checklist of the requirements which needs to be set in the BCR.
- The Working Paper 155 provides FAQ and provides interpretation guidance of some key issues.
Documents useful for the BCR application
The Working Paper 133 is the standard application for BCR approval. You will need to fill in this form in order to designate the lead authority (Part I) and to present to DPAs the commitments you are making in the BCR (Part II).
Documents useful for the national authorisations of transfers based on BCR (the table of national administrative requirements )
According to most EU national laws, data transfers on the basis of BCR still need to be authorised in each Member States where international transfers occur, generally by the European data protection authorities. This table intends to provide relevant information with regard to the different national requirements for the granting of authorisation of transfers on the basis of BCR. This table does not intend to provide information with regard to the EU cooperation procedure for the BCR adoption.
