Processing of Personal Data Working Party on the protection of individuals |
On December 3 the eighth meeting of the Data Protection Working Party was held
in Brussels. During the meeting the Working Party further discussed the matter
of data transfer to non-EU countries, on the basis of a number of fictitious
test cases. The Data Protection Commissioners decided to work closely together
in assessing the adequacy of the data protection in non-EU countries and on
developing ways and means to do this effectively and consistently in all Member
States.
In connection with this further work will be done on:
- the contribution which industry self-regulation can make to providing an
adequate level of data protection in third countries
- and the substantive and procedural questions of recognising the adequacy
of protection in relation to certain transfers (white list).
The Working
Party adopted a recommendation on the basis of the Report and Guidance by the
International Working Group on "Data Protection in Telecommunications on Data
Protection and Privacy on the Internet". As this initiative might contribute
to the improvement of the protection of fundamental rights of individuals, in
particular their privacy, on a world-wide basis, the Working Party recommended
that the European Commission develops proposals on the basis of the
recommendations made in the memorandum to support their implementation through
appropriate international fora.
Finally the Working Party adopted a discussion document on notification and
transparency of processing, which is aimed at facilitating the further
development of consistent procedures for the notification of trans border data
processing operations.
