Implementation of the Public Sector Information Directive 2003/98/EC by the Member States

As of 8 May 2008, all 27 Member States notified implementing measures to the Commission.
Member States have implemented the PSI Directive in different ways:
- 12 MS have adopted specific PSI re-use measures (BE, DE, GR, ES, IE, IT, CY, LU, MT, RO, SE and the UK).
- 3 MS have used a combination of new measures specifically addressing re-use and legislation predating the Directive (DK, AT, SI) and 8 MS have adapted their legislative framework for access to documents to include re-use of PSI (BG, CZ, FI, FR, LV, LT, NL, PT).
- 4 MS have notified the Commission only of measures predating the Directive, with no specific re-use provisions (EE, HU, PL, SK).

On 22 December 2006 the Commission took five Member States (Austria,
Belgium, Portugal, Spain and Luxembourg) to the European Court of Justice
for failure to implement the Directive on the re-use of public sector
information (PSI) on time.
Following the transposition of the Directive by all five Member States, the cases were closed. -
Currently, there are open infringement cases against, three Member States (Poland, Slovak Republic, Estonia) for failure to implement the
