12 December - The "Assessment
of the different models of supply and charging for public sector information"
(SMART 2010/0046) study has been finalised. The study has assessed the
effects of PSI charging models on the downstream market, PSI re-users and
end-users and impacts on the PSB itself. It concludes that the potential
benefits of lowered charges for PSI re-use can be high, since low charges can
lead to more economic activity, market dynamism, innovation and employment. In
addition it has provided a first snapshot of the "Apps"
market and it relation with PSI. Finally, the study provides an insight into
"Open
data" Portals in Europe.

27 October 2011 – Poland - Case C362/10 - The Court of Justice of the EU confirmed that Poland failed to transpose the PSI Directive correctly. The Court agreed with the Commission in regards of all grievances. In particular, the Court stated that persons who would like to re-use PSI should know in which circumstances they can rely on respect of conditions of re-use established by the PSI Directive. According to the Court a national regulation on access to documents is not, by itself, susceptible of transposing the provisions of the Directive with the clarity necessary to satisfy the requirements of legal security and enabling persons who would like to re-use public documents to know all their rights. The Court also stated that a fact that a certain activity is not exercised in a Member State does not dispense that Member State from transposing all the provision of a directive. Such obligation lies on all Members States in order to prevent any possible modifications and to guarantee that everyone in the EU, also in those Member States who don't exercise certain activities, know with clarity and precision and in all circumstances the full scope of their rights and obligations.
27 October 2011 - Estonia and Slovakia - The Commission decided today to send two Reasoned Opinions – the second stage of the infringement procedure - to Estonia and Slovakia for incorrect transposition of the PSI Directive. Estonia and Slovakia have failed to correctly implement most provisions of the PSI Directive, including provisions on definitions, on procedural requirements as well as provisions on prohibition of discriminatory or monopolistic practices by public bodies. Both countries have now two months to inform the Commission of measures taken to ensure the compliance with the PSI Directive. Afterwards, the Commission may refer the cases to the European Court of Justice. Please see the press release.
16 September 2011 - The final report – Review of recent studies on PSI re-use and related market developments undertaken Mr. Graham Vickery -Information Economics- has been finalised . It summarises the findings of the currently available studies on PSI re-use, either sectorial or national, it assesses any changes/development since 2006, and provides estimates of the updated value of PSI re-use in Europe. 31 December 2010 - Prior notice of a call for tenders has been published in TED (Tenders Electronic Daily) for data.gov.eu. The procurement action(s) would support the definition and launch of an initial data.gov.eu initiative for the benefit of reusers across Europe and eventually becoming the recognised and widely used European access point to government information.
3 December 2010 - On 3 November 2010 we invited experts with practical experience on publishing government open data to discuss the opportunities for and technical challenges of establishing a pan-European open data portal: what would be the benefits? How should it be established? What services could it and should it offer? We are now publishing a complete summary of this discussion in this report.
30 September 2010 - The Commission decided to close the infringement proceedings against Italy and Sweden for incorrect transposition of the PSI Directive. In both cases, the national authorities have accepted to adapt their legislation to transpose the PSI Directive along the lines of the remarks expressed in the letters of formal notice addressed to them by the Commission: new PSI Act Lag 2010:566 entered into force 1st July, in the case of Sweden, and Article 44 of Legge Comunitaria 2009 entered into force 10 July 2010, in the case of Ital

9 September 2010 - Today the Commission launched a public consultation on the PSI Directive. All interested parties – public sector bodies, re-users, developers, researchers and citizens – are invited to participate in the consultation which includes questions on the PSI re-use context and possible action to consider, substantive issues regulated by the PSI Directive, practical measures, changes that have taken place and barriers that still exist, and other issues. The consultation will feed into the debate on possible policy options that should be considered for the review, and will contribute to the impact assessment that will be carried out subsequently, associated with proposals for possible legislative or other measures. The consultation will close on 30 November 2010.
8 September 2010 - The report on the work undertaken by the Commission's PSI Group and sub-working groups on Economic Indicators and PSI Charging Models has been finalised. More information on the economic analysis page.
8 September 2010 - The reports to identify the potential existence of Exclusive Agreements for Belgium, Austria, Czech Republic, Denmark, Poland, Spain, Italy and France have been finalised. Whilst most of the studies have yielded leads to potential Exclusive Agreements in Member States, overall the studies have found out that the number of potential Exclusive Agreements are very few in the EU, and that these are not a major obstacle hindering the full potential of PSI re-use in Europe. The studies also provide some insight into the current PSI developments in Member States and hint to those areas which may be preventing PSI re-use in each respective Member State.

18 August 2010 - A public tender Follow up to the PSIplatform was published today. The purpose of this tender is the purchase of a follow up service to the PSI Platform for the promotion of a dynamic PSI re-use market across the EU. The new project/services will build on the work and content of the current web site. The future contractor will, in addition, monitor the impact on the re-use of PSI of new policies in key areas such as: pricing and charging policies, licensing, complaints and redress procedures, information systems for facilitating access to and re-use of PSI, etc. All interested parties are requested to submit their tender no later than 22 September 2010. 10 July 2010 - In Italy, Article 44 of Legge Comunitaria 2009 (the legislative package adopted to implement obligations steaming from EU law) entered into force on 10 July 2010. It introduces changes to the national PSI rules to meet the requirements of the Directive. The changes aim in particular to incorporate the general principle contained in Article 3 of the Directive and to amend other provisions which restricted scope of the re-use legislation on grounds of lack of ownership of the requested data by the relevant public sector body or of its nature (e.g. cadastral or statistical data)."
7 July 2010 - The final report of the Commission's survey on the ePSIplatform web site (reference to the news items of 29 and 1 June below) has been published. According to the respondents' opinions, the ePSIplatform web site is very much appreciated. The content of the web site is competent and up-to-date. However, respondents consider that there is a need for a better structure and presentation of the information.
1 July 2010 - Sweden has recently adopted new public
sector information (PSI) legislation to comply with the EU rules on re-use of
public data, following letters of formal notice sent by the Commission for
incorrect transposition of the PSI Directive.
The new Swedish law,
Lag
2010:566 entered into force on 1 July 2010, specifically purports to promote
the development of an information market by facilitating re-use by individuals
of documents supplied by the authorities on conditions that cannot be used to
restrict competition.
1 July 2010 - The Committee of the Regions has issued an opinion on the review of the PSI directive which was published in the Official Journal C 175 Volume 53.
9 June 2010 - The 9 June 2010 Madrid (Spain) meeting "Realising the value of Public Sector Information" hosted by Proyecto Aporta and the ePSIplatform attracted close to 200 participants from throughout Spain and Europe. During the meeting, interviews were conducted and filmed with roundtable panel members from the public and private sectors. One of the interviews conducted was with Javier Hernández-Ros, head of the DG INFSO, E4 - Access to Information Unit responsible for the PSI Directive.
30 July 2010 - Ex-ante advertising for the negotiated procedure for a service contract of a value below or equal to 60.000€ for the study "PSI: Re-use of cultural material". The purpose of this contract is to collect relevant information on (1) the importance of re-use in terms of revenues for cultural institutions and (2) on trends in the development of re-use market for cultural material. Deadline for submission of offers is 13 August 2010.

29 June 2010 - Preliminary results of the Commission's survey on the ePSIplatform portal (reference to the news item of 1 June below).
29 June 2010 - The presentations of the 13th PSI Group meeting, which took place on 24 June, are now on-line. The first part of the meeting focused on the developments of the PSI re-use in the MS, and the second one on the open-data/PSI community perspectives and LAPSI (Legal Aspects of Public Sector Information) network.

24 June 2010 - The Commission decided to refer Poland to the Court of Justice for incorrect implementation of the PSI Directive. The Commission believes that Poland has failed to transpose the main provisions of the PSI Directive into the national law. Polish legislation does not yet contain the general principle related to individuals' rights to re-use public sector information and the public sector bodies' corresponding obligations as set out in the Directive. Polish law also lacks provisions on subject matter, procedural requirements, specific conditions of re-use, as well as provisions on non-discrimination and prohibition of exclusive arrangements. For these reasons, the Commission decided to bring the matter before the European Court of Justice. The Court will now deliver a judgment stating whether there has been an infringement of the EU law. 1 June 2010 - The Commission has launched a survey to identify the strengths and weaknesses of the ePSIplatform portal in the light of a possible follow up to the service. The survey requires neither personal data nor registration, and is completely anonymous. The survey will end on 18 June 2010. The ePSIplatform portal was launched in February 2009. Its aim is to stimulate action, report developments and monitor progress towards a stronger and more transparent environment for the growth of PSI re-use.
20 May 2010 - The Commission is organising the 13th meeting of the Public Sector Information Group which will take place on 24 June 2010 in Luxembourg. Agenda.
20 May 2010 - The final country reports – "PSI: Identification of potential Exclusive Agreements - Austria" and "PSI: Identification of potential Exclusive Agreements - Czech Republic ". The studies have been finalized in Austria and in Czech Republic. They have yielded 2 leads, both in Czech Republic, to potential EAs that are to be further investigated. 19 May 2010 - In the context of the "Digital Agenda for Europe"; the review of Directive has been signaled as a key action of the initiative and is foreseen for 2012. The re-use of PSI has been highlighted as a key driver to develop content markets in Europe, and has been included within the Digital Single Market area. The Commission is starting to work on the revision and is planning to carry out its stakeholder consultation shortly.

26 January 2010 - Commission action triggers new PSI bill in Italy - Following a letter of formal notice sent by the Commission to Italy on 23 March 2009 for incorrect transposition of Directive 2003/98/EC on the re-use of public sector information (PSI), the Italian authorities accepted to change their legislation transposing the Directive and proposed new PSI legislation, which is now pending before the Parliament as part of the legislative package to implement obligations stemming from EU law (Legge comunitaria 2009, A. S. n. 1781). The proposed changes to the national legislation aim in particular to incorporate the general principle contained in Article 3 of the Directive and to amend other provisions which might restrict the scope of the re-use legislation on grounds of lack of ownership of the requested PSI by the relevant public sector body or of its nature (e.g. cadastral or statistical data). 19 January 2010 - After the announcement last year (see the news item of 9 December 2009), today the UK Government launched a www.data.gov.uk - an on-line access point to government-held non-personal data. The aim is to enable the re-use of data and make new applications with it. The portal features include datasets, browsing (users can browse datasets by listing as well as common subject tags), Wiki (the site integrated a wiki which enables the sharing of community knowledge; every dataset links to a wiki page which includes some example headings), forum (registered users can discuss aspects of the project in more depth), as well as SPARQL, ideas and applications page.

10 December 2009 - The Commission has finalised its tendering procedure and awarded the contracts for the study for assessing the existence of exclusive agreements concluded by public sector bodies within certain EU Member States (MS) in the context of the PSI Directive. A first set of Member States (France, Germany, Italy, Poland, Spain, Austria, Denmark, Belgium and the Czech Republic) will be object of the study in 2010. Please find below a list with the economic operators awarded with the task of undertaking such an exercise per Member State. Should you believe of the possible existence of exclusive agreements in a European Country please provide the relevant economic operator with the relevant information. Further information.
9 December 2009 - The Swedish authorities sent to the Commission the official report with the proposed Swedish legislation transposing Directive 2003/98/EC on the re-use of Public Sector Information, which was sent out to the stakeholders for a formal consultation during Fall 2009 as a step in the Swedish legislative process, and confirmed that in spite of some delay during the Summer break, they still expect the new legislation to enter into force on 1 July 2010, as planned and reported to the Commission. The Commission participated in the seminar Stimulating PSI re-use: European Progress organised by the ePSIPlatform in Stockholm on 24 November 2009, where the Swedish PSI bill was also commented and the calendar for adoption confirmed. 9 December 2009 - PSI Developments in the MS: The UK Government published on December 7th an action plan "Putting the Frontline First - Smarter Government" which contains an ambitious and proactive PSI reuse agenda: "Our public data principles state that: Public data will be published in reusable, machine-readable form; Public data will be available and easy to find through a single easy to use online access point (www.data.gov.uk); Public data will be published using open standards and following the recommendations of the World Wide Web Consortium; Any "raw" dataset will be represented in linked data form; More public data will be released under an open licence which enables free reuse, including commercial reuse; Data underlying the Government’s own websites will be published in reusable form for others to use; Personal, classified, commercially sensitive and third-party data will continue to be protected."
10 and 18 November 2009 - In November 2009 two events organised under the Swedish Presidency ended with important political declarations in support of the EU PSI policy agenda. In Visby, on November 10th, participants adopted the "Visby Declaration - Creating impact for an eUnion 2015". The second event happened on November 18th in Malmö, where European Ministers responsible for eGovernment policy unanimously approved the "Ministerial Declaration on eGovernment". Both declarations recognise the economic potential of the PSI re-use and call on the MS "to make data freely accessible in open machine-readable formats, for the benefit of entrepreneurship, research and transparency".
16 November 2009 - Conclusions of the 25 September meeting on PSI portals: Technological, organisational and financial aspects of PSI portals do not represent a real issue. There is enough knowledge, technology and good practice available on which to build PSI portals. Open-source tools enable setting up a PSI portal with relatively low costs. 10 November 2009 - Javier Hernández-Ros, the Head of Access to Information Unit, is the ePSIplatform PSI Guest Blogger in the month of November. The ePSIplatform project is funded under the European Commission’s eContentplus programme. Its goal is to stimulate action, report developments and monitor progress towards a stronger and more transparent environment for the growth of national and European PSI re-use markets. The aim of the blog is to stimulate debate and discussion about the latest news, opinions, and strategies related to PSI re-use.
2 November 2009 - Today the Polish Ministry of the Interior held a consultative meeting on the proposed assumptions for the new law and on the need for Poland to respond to the European Commission infringement action (more information). So far, neither the legislative calendar nor the text of the proposed Act have been published.
25 September 2009 - The European Commission organised a meeting on the public sector information portals. The first part of the meeting focused on existing portals and portals underway from some of the Member States. The representative from the PSI Alliance presented the "reusers' wishlist" as concerns the PSI portals. The second part of the meeting addressed technological, financial and organisational challenges. Agenda. 24 September 2009 - Following infringement proceedings Poland has announced the planned adoption of a self-standing Act in the re-use of public sector information. The Polish Ministry of Internal Affairs and Administration published a consultation document entitled: Assumptions for the draft law on re-use of public information (Założenia do projektu ustawy o ponownym wykorzystaniu informacji publicznej).

1st of March 2009 - The European PSI Platform was launched. The main purpose of this portal is to promote a a dynamic PSI re-use market across the EU. It will provide news on European PSI developments, legal cases around re-use, good practices and examples of new products and services. it will cover the main PSI re-use sectors (geographical, meteorological legal, business information, etc.) following a sectorial approach when needed to grasp the dynamics of specific domains. The project is funded under the European Commission's eContentPlus Programme. The service is active from March 2009 to February 2011.

7 July 2008 - A public tender "European Public Sector Information (PSI) Platform" was published in Tenders Electronic Daily (TED) and the Supplement to the Official Journal of the European Union, 2008/S 129-170660. The purpose of the call is to establish a European PSI central platform to further stimulate action and monitor progress towards a stronger and more transparent environment for the growth of national and European markets in PSI re-use, following the review of the PSI Directive. The service will be built around an interactive web-based portal ("one-stop-shop"), providing news on European PSI developments, emerging good practices, examples of new products and services and legal cases around PSI re-use. The work will build on earlier activities supported through the Commission funded eContentPlus programme (notably the ePSIplus thematic network) and within Member States.
30 June 2008 - On 17-18 June 2008 Ministerial Meeting on the Future of the Internet Economy the OECD released the "Recommendation" (PDF file) of the Council for Enhanced Access and More Effective Use of Public Sector Information". The Recommendation is designed as a general framework for Member countries to foster wider and more effective use of public sector information and content, and the generation of new uses from it. It lays out principles for openness and transparent conditions for re-use, quality and integrity, new technologies and long-term preservation, copyright, pricing, competition and redress, and international access.
13 June 2008 - ePSIplus conference "PSI Re-use – Who Takes Action Next?" was held in Brussels today. Horst Forster, Director, Directorate E of DG INFSO, addressed the participants with a speech "Re-use of Public Sector Information: Change, Growth and Transformation (PDF file).
ePSIplus is a Thematic Network, funded by the eContentplus programme, to support the implementation of the European Directive on Public Sector Information Re-use, in the period leading up to its review in 2008.
8 May 2008 - Today Belgian authorities notified the Commission last federal measures (see below), which complete implementation of the PSI Directive into national law. This means that all MS have now completed transposition of the PSI Directive.

24 April 2008 - On 6 May 2008 the Digital Libraries and Public Sector Information unit (E4) is organising the 11th PSI Group meeting with representatives from Member States and industry. The meeting will focus on the review of the PSI Directive scheduled for this year, the views of the private sector for promoting PSI re-use and good practices and policies supporting the re-use of PSI.
24 April 2008 - On 29 April 2008 the Digital Libraries and Public Sector Information unit (E4) will organise together with the Copyright unit of the Publications Office (OPOCE) a meeting on "copyright and re-use of Commission information". E4 and OPOCE will present to the Commission services both a strategy and practical measures for dealing with the Commission's reusable information resources: how to identify them, clarify the conditions for re-use and how to promote their re-use. The subject of the meeting is in line with Commission Decision 2006/291/EC Euratom of 7 April 2006 on the re-use of Commission information. The meeting is targeted to re-use correspondents, web masters and publication correspondents of the different DGs.
14 March 2008 - The Prior Information Notice concerning the future call for tender "European public sector information (PSI) platform", was published in the Supplement to the Official Journal of the European Union 2008/S 50-068020 (PDF file) on 12 March 2008.The Contract Notice will be published later this year and subsequently the tender specifications and the other tender documents will become available.
18 January 2008 - European Commission makes computer-assisted translation easier and more accessible: The European Commission is going a step further in its efforts to foster multilingualism as a key part of European unity in diversity. The Commission's collection of about 1 million sentences and their high quality translations in 22 of the 23 official EU languages — including those of the new Member States — is the biggest ever collection in so many languages and is now freely available. This kind of data is highly sought after by developers of machine translation systems in which automatic translation software "learns" from manually translated texts how words and phrases are correctly and contextually translated. The data can also help the development of other linguistic software tools such as grammar and spell checkers, online dictionaries and multilingual text classification systems. Full press release

7 September 2007 - Today Austria and Portugal notified the Commission of full transposition of the PSI Directive. With this act, Austria has completed full transposition of the PSI Directive through one Federal law and nine State laws.

31 July 2007 - Two years after UK implementation of The Re-Use of Public Sector Information Regulations 2005 (PSI Regulations), the Office of Public Sector Information (OPSI) published a report (PDF file) today, on progress made in the UK in the field of PSI.

27 June 2007 - Call for tender: "Assessment of the re-use of public sector information (PSI) in the geographical (cartographic-mapping and cadastral) information, meteorogical information and legal information sectors" was published today in the Supplement to the Official Journal of the European Union 2007/S 121-147642. The subject of the contract is to gather quantitative and factual data and information on the re-use of PSI as a means to measure the impact of the PSI Directive in the EU.

25 June 2007 - Today the UK Government responded to the OFT CUPI study (Office of Fair Trading, The Commercial Use of Public Information, PDF file). In its response (PDF file), the UK Government welcomed the OFT market study, which identifies some important and complex issues where the PSI market is not functioning as well as it could. The UK Government welcomed the OFT recommendations, and is able to accept the majority of them, but there are some that require further work. In its response, the UK Government also said that it is keen to establish what can be done, working with others, to address the issues identified by the OFT most effectively.

4 June 2007 - On 4-5 June 2007 an International Symposium "Public Data on the Private Market - New Regulations on the Re-Use of Public Sector Information" was held in Potsdam, Germany (Programme; PDF file; EN and DE language). On the first day of the symposium, 4 June 2007, Horst Forster, Director Digital Content and Cognitive Systems at the Information Society and Media Directorate General (European Commission) gave a speech "Public Sector Information: A Motor for Growth and Employment" (PDF file; EN language).

10 May 2007 - The 10th meeting of the PSI Group will take place on 21 June 2007 in Luxembourg. The first part of the meeting will deal with the views of the private sector on PSI re-use, with the intervention representatives from industry. The second part of the meeting will focus on issues related to the transposition and application of the PSI Directive and on the INSPIRE initiative (Infrastructure for Spatial Information in Europe). The last part will deal with good practices and policies supporting the re-use of PSI.

22 December 2006 - The European Commission is taking five Member States (Austria, Belgium, Portugal, Spain and Luxembourg) to the European Court of Justice for failing to put into practice the Directive on the re-use of public sector information (PSI). The re-use of PSI has enormous economic potential as it represents a raw material for new added value services and products worth from €10-48 billion in the EU alone. Read a press release.

11 December 2006 - The Office of Fair Trading (UK) published a study The Commercial Use of Public Information (PDF file; 700 KB). The OFT’s market study has found that more competition in PSI could benefit the UK economy by around £1billion a year. The study found that raw information is not as easily available as it should be, licensing arrangements are restrictive, prices are not always linked to costs and Public Sector Information Holders (PSIH) may be charging higher prices to competing businesses and giving them less attractive terms than their own value-added operations. The report has also found that much of the legislation and guidance which aims to ensure access to information is provided on an equal basis, lacks clarity and is inadequately monitored. As a result the full benefits of PSI are not being realised. The OFT concludes that PSIHs should:
make as much PSI available as possible for commercial use/re-use;
ensure that businesses have access to PSI at the earliest point that it is useful to them;
provide access to information where the PSIH is the only supplier on an equal basis to all businesses and the PSIH itself;
use proportionate cost-related pricing and to account separately for their monopoly activities and their value-added activities so that PSIH’s can demonstrate that they are providing and pricing information fairly and in a non-discriminatory manner, and
enable the regulator (Office of Public Sector Information) to monitor PSIHs better, with improved enforcement and complaints procedures.

24 November 2006 - The 9th Meeting of the PSI Group will take place in Luxembourg on 28 November 2006. The meeting will first of all discuss progress on the transposition and application of the PSI Directive in Member States and present the recent Commission Decision on the re-use of Commission information. The second part of the meeting will deal with complaints lodged to the Commission and in some Member States and the third part with good practices and policies supporting PSI re-use.
The PSI Group is a forum for the exchange of good practices between Member States on re-use of PSI. It also serves as a platform for discussing progress on the transposition and application of the PSI Directive 2003/98/EC, as well as other issues of common interest in relation to this Directive.

30-31 October 2006 - The ePSIplus Thematic Network Kick Off Meeting was held in Prague on 30 and 31 October. ePSIplus is a Thematic Network, funded by the eContentplus programme, to support the implementation of the Directive on PSI re-use, in the period leading up to its review in 2008.
23 October 2006 - In October Malta and Cyprus notified the Commission that they have transposed the PSI Directive into their national laws. 1 September 2006 - MEPSIR study was published (three PDF files - Executive summary, Final report 1st part, Final report 2nd part). The study defines, tests and applies a methodology to measure the re-use of PSI in the Member States and Norway, serving as a basis for the review of the PSI Directive envisaged in 2008.
June 2006 - the Commission publishes the results of its MEPSIR study which confirms the economic potential and importance of the re-use of public sector information. The overall market size for public sector information in the EU is estimated between EUR 10 and EUR 48 billion, with a mean value around EUR 27 billion. This amounts to 0.25% of the total aggregated GDP for the EU (EUR 10.730 billion). This Decision determines the conditions for the re-use of documents held by the
Commission or on its behalf by the Office for Official Publications of the
European Communities (Publications Office) with the aim of facilitating a wider
re-use of information, enhancing the image of openness of the Commission, and
avoiding unnecessary administrative burden for re-users and the Commission
