Monitoring Transposition
-
The Commission is monitoring to see if the Member Sates have adopted transposition measures and whether these measures correctly transpose all the provisions of the Directive. If necessary, the Commission provides support to officials in the Member States responsible for the transposition.
-
The PSI Directive was adopted on 17 November 2003 and published in the Official Journal of the European Union on 31 December 2003. Member States had 18 months to transpose the directive into national law, i.e. until 1 July 2005.
-
According to the Treaty establishing the European Community, "a directive shall be binding, as to the results to be achieved, upon each Member State to which it is addressed, but shall leave to the national authorities the choice of form and methods" (Article 249, paragraph 3).
