July 2012 - Report on Costing Methodologies and incentives to invest in fibre networks conducted by Charles River Associates (CRA) PDF format (EN - 1.7MB)
The report finds that if investments in fibre networks are to be encouraged, the price at which investors are mandated to provide access must be high enough to reflect the true costs of investment. CRA further states that Incentives to invest in fibre are affected not only by the fibre access price but also the access price for existing copper networks. In a world where copper and fibre networks co-exist, lowering the copper access price may not be an effective way to encourage fibre investment. Copper access should be regulated in a way that considers the possible effects on competition from other technologies.

June 2012 - eCommunications household survey: The results of a special Eurobarometer survey, SMART 2011/0011 conducted by TNS Opinion & Social between 3 and 18 December 2012 to measure the attitude of European households and individuals towards fixed and mobile telephony, Internet access, TV broadcast services, bundled offers, quality of services, transparency, switching, blocking and monitoring, affordability and data privacy.

The survey covers the 27 EU Member States, with an average of 1,000 households interviewed per country. It follows on from the previous Eurobarometer survey which was conducted between February and March 2011.

The completion of the Internet Market for electronic communications has the potential to bring yearly gains in GDP of up to 110 billion euros through more competition and economies of scale. An integrated and interoperable Internal Market would ensure that every European has access to all content and services, everywhere throughout the EU.

November 2011 - Impact of EU Policy options for revision of the universal service provision, SMART 2009/0012 conducted by the consortium lead by Van Dijk Management Consultants and comprising SVP Advisors and time.lex in October 2010.

The studies' main objective is to formulate potential policy options on the future of universal service, in particular in the context of broadband developments, and to provide qualitative and quantitative assessments.

April 2011 - Study on the Future of Interconnection Charging Methods, SMART 2009/0014 - Prepared by Tera Consultants/Hogan Lovells, November 2010

The study investigates whether there is a case to move beyond the improved interconnection charging regime for the termination of a phone call on a fixed or mobile network, so called "calling party network pays", or "CPNP", to a "Bill and Keep" regime when taking into account technological change and market developments. The study compares the merits and drawbacks of Bill and Keep v CPNP based on economic literature and case studies. It assesses the regulatory requirements associated with overseeing any (voluntary or mandated) move to BAK system. The study concludes that there is only a weak case to mandate BAK instead of improved CPNP in Europe given the expected impact of the Recommendation of 7 May 2009 on the regulatory treatment of fixed and mobile termination rates in the EU with the incremental cost of voice call termination approaching zero.

October 2009 - Study on activities undertaken to address threats that undermine confidence in the Information Society, such as spam, spyware and malicious software, SMART 2008/0013
The Study collects up-to-date information on the actions taken In EU Member States by competent national authorities and by electronic communication network and service providers against spam, spyware and malicious software.
The Study was drafted on the basis of answers obtained from national correspondents to a questionnaire containing the Commission’s questions on the take up in and by Member States of actions proposed in the Commission’s Communication of 2006 on this topic.

March 2008 - The Regulation of VoIP in Europe, SMART 2007/0014 - prepared by WIK-Consult.

In recent years those type of VoIP services falling under the EU Regulatory Framework have been subject to a variety of different national regulatory environments. This Study sets out to investigate the degree of harmonisation (or lack of it) as regards VoIP regulation in the Member States, considers the degree to which lack of harmonisation might be impairing competitive entry of VoIP service providers and thus causing harm to the broader economy, and makes recommendations as to how the Commission could alleviate any problems that might be identified.

February 2008 - The Future of IP Interconnection: Technical, Economic and Public Policy Aspects, SMART 2006/0009 - prepared by WIK-Consult.

Network interconnection by means of the Internet Protocol (IP) has been a vital enabler of the Internet’s ubiquity and success. IP-based interconnection has usually been achieved without explicit regulatory obligations, and has for the most part been highly effective. Given the rapid evolution of the economic, technological and social environment this study investigates whether IP interconnection is still better left unregulated.

January 2008 - Comparison of Privacy and Trust Policies in the Area of Electronic Communications, SMART 2006/0007 - prepared by wik-Consult/Rand Europe, July 2007.

The study compares what systems are present in the United States and a number of advanced Asian countries to protect privacy and enhance trust in the realm of electronic communications.  Additionally, the study reports on the effectiveness of these arrangements and the perceptions of various stakeholders of these different systems.

November 2006 - Digital Television Data: EU-Market for Digital television: The report prepared by Dataxis for the European Commission covers years 2004 and 2005.  It provides data per Member State on TV households and on platform penetration of analogue and digital services and on the evolution in the percentage of digital households.  It provides also information on interactive digital TV services per platform and on the market position of MHP and covers e-government services provided via digital TV.

July 2006 - Preparing the Next Steps in Regulation of Electronic Communications - A contribution to the review of the electronic communications regulatory framework, SMART 2005/0009

The main goal of this study is to contribute to the Commission’s review during 2006 of the Regulatory Framework governing electronic communications in the European Union.  Research focused on the following questions: How well has the existing Regulatory Framework fared in realising the Community’s objectives, and what changes might be warranted?  How is the sector likely to evolve, and do any of these changes have implications for the appropriate regulatory environment?  The study also sets forth a number of recommendations.

July 2006 - Experts’ report in relation with the Review of the Recommendation on markets subject to ex ante regulation, SMART 2005/0054

(Dr Uli Stumpf, Professor Martin Cave and Professor Tommaso Valletti)

This report offers advice to the European Commission on the review of the Recommendation on relevant markets that may be subject to ex ante regulation.  It covers activities corresponding to all the markets identified in the current Recommendation, with the exception of wholesale international roaming and broadcasting transmission.

September 2005 - Study on pan-European market for premium rate services, SMART 2004/0014, by Cullen International and WIK Consult.

This study provides a complete picture of the provision of premium rate services at the national level in Member States (see annex), and identifies/recommends the steps to be taken to establish a complementary European single market for these services so as to support the competitive supply of premium rate services at pan-European level.

September 2005 - Report on the public policy treatment of digital terrestrial television (DTT) in communications markets , SMART 2004/0066

This study is produced by Analysys for DG Information Society and Media, European Commission. The report places DTT in the context of other digital television platforms and draws upon experience to date to identify DTT success factors. Public policy towards DTT is explored, highlighting the objectives of Member States. The extent to which public institutions may legitimately support DTT is explored, as is the contribution of new digital technologies.

September 2004 - Telecoms services indicators 2004, SMART2001/0003

The results of a residential survey conducted by INRA for the European Commission to monitor developments in the diffusion and usage of electronic communications services in connection with the regulation in the field of universal service. The survey took place between the end of 2003 and and the beginning of 2004 and consisted of over 44,000 household interviews in 127 regions of the 15 pre-accession Member States.

June 2004 - Study on spectrum management in the field of broadcasting, SMART 2003/0002 by Aegis Systems Ltd, Indepen Consulting Ltd and IDATE.

This study identifies the challenges to spectrum management arising from the digital transition and analyses the possibilities and limits of new spectrum management approaches and tools that have become available.  The study evaluates and advises on the feasibility of these new approaches within current administrative and regulatory frameworks.

May 2004 - Study on conditions and options in introducing secondary trading of radio spectrum in the European Community, SMART 2003/0001 by Analysys Consulting, DotEcon, Hogan & Hartson - full report

This study analyses and identifies the options available for a liberalisation of spectrum use and the implementation of spectrum trading. It considers whether there are benefits from co-ordination of approaches across the EU and what issues to address in this respect.

February 2004 - Study on Internet protocol (IP) voice and associated convergent services, SMART 2002/0001

This report by Analysys identifies and explains the important issues associated with the transition from the existing circuit-switched public switched telephone network (PSTN) to IP packet-switched networks for the provision of voice and associated convergent services. These issues encompass regulation, technology, economics and the structure of the telecoms market.

2003

December 2003 - Report on Telecoms Price Developments from 1998 to 2003

The report provides updated information on telephony tariffs as of August 2003, for the 15 EU countries, US and Japan, for the following telecommunications services: business/residential tariffs basket for national/international PSTN calls (using the OECD basket methodology); business/residential digital mobile tariffs basket; local regional, national and international leased lines tariffs.

November 2003 - Economic Expert Group on Remedies

In July 2002 and February 2003 respectively, the Commission adopted "Guidelines for market analysis and the assessment of significant market power" and a "Recommendation on relevant markets" in accordance with the 2003 Regulatory Framework. Following the publication of the recommendation on relevant markets, DG Infso set up a small economic expert study group to analyse and provide guidance on the selection of regulatory obligations or remedies under the new framework. The expert group comprised Professor M. Cave, Dr. C. Koboldt and Dr. T. Valletti and three reports have been produced concerning broadband servicesnarrow-band services and mobile services. November 2003 - Study on Barriers to Competition in the Supply of Electronic Communications Networks and Services

This study, prepared by Ovum, looks at barriers to competition in the supply of electronic communications networks and services (ECNS) in the EU. Main market areas covered are fixed network services , mobile services, television services, and Internet based services (e-services). The study also looks at the supply of software for 3G mobile services.

November 2003 - A Study On The Internet Corporation of Assigned Names and Numbers (ICANN)

The results of a study, conducted by the College of Europe in Brugge for the European Commission, on ICANN - the not-for-profit corporation from California that plays an important role in the coordination and functioning of the global Internet. The study consists of four parts:

1. An analysis of ICANN's status, its mission, functioning and decision-making process.
2. Economic analysis.
3. Legal aspects.
4. Conclusions and recommendations.

October 2003 - Telecoms services indicators 2002

The survey took place in the second half of 2002 and consisted of over 44,000 household interviews in 127 regions of the 15 Member States.

September 2003 - Study on the policy implications of convergence in the field of naming, numbering and addressing

Governments and regulators need to be aware of the strategic value of converged naming, numbering and addressing schemes. What is the role of the traditional organisations for the management of these key resources in converged networks and to what extent could industry self-regulation play a role? The study provides a broad orientation into some of the key issues.

June 2003 - Study on regulatory implications of the introduction of Next Generation Networks and other new developments in electronic communications by Devoteam/Siticom.  

The study identifies a large number of potential market control points. Some of these control points may be anti-competitive, could be or become persistent and could require regulatory attention. For regulators and the Commission seeking to ensure a fair and well functioning market, it is of obvious interest to understand where new sources of market power can be found and what mechanisms will emerge. This will require an understanding of new technologies and how they interrelate. The report contains some technical chapters which have been developed with that objective in mind. 

March 2003 - Study on the assessment of the Member States measures aimed at fulfilling certain general interest objectives linked to broadcasting, imposed on providers of electronic communications networks and services, in the context of the new regulatory framework,by Eurostrategies.  

Among the different issues analysed by the consultants are : (1) the economic implications of must-carry obligations, and the definition of a process to define a remuneration for cable operators to compensate the costs linked to the must-carry obligation that would meet the conditions set forth in the New Regulatory Framework, which states that the remuneration if any has to be implemented in a way that is proportionate and non-discriminatory; (2) the appropriateness of spectrum valuation and the difficulties associated with moving from spectrum valuation to spectrum pricing in a sector like broadcasting which takes place in a multi-platform environment, and in the presence of general interest obligations on the broadcasters ; (3) how far there is a need for regulatory intervention in order to define how conditional access services should be priced and if so, who should pay the costs associated with the provision of these services. 

March 2003 - Study on Interoperability, Service Diversity and Business Models in Digital Broadcasting Markets, by Oxera.  

The primary focus of this study is to identify the ways in which interoperability could be developed in the European digital broadcasting market, and to assess options that are identified. In order to help inform Commission policy towards digital broadcasting as the sector grows and matures, the study is intended to provide the Commission with a set of policy options for (1) stimulating competition in horizontal retail markets through increased interoperability (2) encouraging increased take-up of related display formats, such as wide-screen; and (3) addressing the barriers to the take-up of digital audio broadcasting (DAB).

2002

November 2002 - Study on Regulatory framework and market developments concerning directory services in EU and EEA Member States, by Analysys Consulting.

The study (1) examined the implementation of Article 6 of the EC Voice Telephony Directive 98/10/EC across EU and EEA Member States (Article 6 imposes specific requirements for the provision of directories and directory enquiry services); (2) assessed whether any remaining barriers to competition exist (i.e. regulatory, technical, commercial and content-related); and (3) investigated the feasibility of a pan-European directory database. It concluded that there are no major legal or regulatory barriers to the creation of a pan-European market for providing directory services; rather a better implementation of existing rules and policy seems needed.

July 2002 - Study on Market Definitions for Regulatory Obligations in Communications Markets, by Squire Sanders and Dempsey.  

The study examines and analyses markets in the electronic communications sector with a view to defining relevant markets for ex-ante regulation. It also attempts to develop guiding principles or criteria for identifying candidate markets for ex-ante regulation. 

May 2002 - Study on The Economics of IP Networks - Market, Technical and Public Policy Issues Relating to Internet Traffic Exchange, by WIK-Consult.  

The study provides descriptions and analysis of some issues concerned with commercial traffic exchange on the backbone Internet: market structure and competition, addressing, quality of service. 

May 2002 - Study on enhancing emergency service by location information (E112) by Helios Technology.  

The report  proposes a "best efforts" approach, relying on the location technology that exists today in GSM systems, and on the fact that there are strong commercial drivers for mobile operators to develop enhanced location based services in the future.  This approach will help to establish the links between the operators and emergency services.  As we learn, we may then see whether more stringent measures are needed in 2-3 years time, and therefore the report recommends a review. 

April 2002 - Study on Digital Switchover in Broadcasting by BIPE consulting.  

This study addresses the migration process from analogue to digital television and radio broadcasting until analogue broadcasts are definitively turned off, describing the situation in the EU and other countries, analising market and spectrum implications and making recommendations. November 2000 - Final Evaluation of the 16:9 Action Plan 1993 - 1997, by IDATE.

This  study of the impact of the funding intended to facilitate the development of widescreen television in the European Union is the latest of a series of evaluation reports and associated documents which are being published via the 'Information Society Evaluation' page.

November 2000 - Study on legal issues relevant to combating criminal activities perpetrated through electronic communications, by The Computer Related Crime Research Unit Queen Mary, University of London.

This follow-on study has been completed, November 2000,  to examine ways of improving transnational cooperation between interested parties in industry and law enforcement in order to combat transnational crime with the necessary rapidity.
