Judges Seminar
Introduction
Since 2005 a series of seminars for national judges focusing on various
aspects of telecoms regulation have been organised on behalf of the European
Commission. These seminars are intended to provide a forum for judges,
regulators, the Commission, the Court of Justice and academics to inform,
explain, and exchange experiences, views and visions with regard to:
• the development of EU telecoms
rules;
• the national judiciaries' role in
furthering consistency in the regulation of the electronic communications sector
and the involvement of national and European judges in the regulation of the
sector; and
• the enforcement and harmonisation of
e-communications regulation in the EU.

REGULATORY FRAMEWORK IN ELECTRONIC COMMUNICATIONS - Brussels, European
Commission premises
The 2011 seminar for national judges and representatives of national regulatory
authorities (NRAs) was organised by the Academy of European Law (ERA) in
association with the European Commission, Information Society and Media
Directorate-General.
Following the adoption of the new EU rules on Telecommunications in 2009 and other important complementary harmonisation measures in 2010 and 2011, this years' focus was on the role of the national judiciary in implementing the revised regulatory framework in electronic communications, with particular attention to some specific issues concerning the appeal procedure against decisions adopted by NRAs. The seminar also dealt with the important role of European institutions, like the European Commission, the Court of Justice of the European Union and the newly created Body of European Regulators for Electronic Communications (BEREC), in achieving a true single market in electronic communications.

29 November 2010 - Seminar for national judges: RECENT DEVELOPMENTS OF
THE EU TELECOMS RULES - Brussels, European Commission premises
The fifth seminar for national judges and representatives of national
regulatory authorities was organised by the Academy of European Law ('ERA') on
behalf of the European Commission (DG Information Society and Media).
The revision of the e-communications Regulatory Framework has been completed
successfully in 2009 and put in place a revised set of rules to be implemented
by the 27 Member States by May 2011 at the latest, which will pave the way
towards a strengthened European market. The new package amended substantially
the previous framework and brings new challenges for all the players involved
including national judges and regulators. Furthermore, a Digital Agenda for
Europe, being one of the key initiatives of the forthcoming EU 2020 strategy,
was adopted in April 2010.
This fifth seminar for national judges mainly focused on:
the impact of the revised regulatory framework and other harmonisation
measures taken recently in the view of the European Digital Agenda;
the national judiciaries' role in achieving a truly single market by further
improving consistency in the regulation of the electronic communications sector;
recent developments in the jurisdiction both at national and European level.

30 November 2009 - Seminar for national judges: Challenges following the
forthcoming reform of the EU telecommunications rules - Brussels, European
Commission premises
The fourth seminar for national judges and representatives of National
Regulatory Authorities was organised by the Academy of European Law ('ERA') on
behalf of the European Commission (DG Information Society and Media).
The seminar aimed at highlighting key issues of the telecoms reform and its
impact on the role of judiciaries and regulators in the sector. The role of
National Regulatory Authorities was discussed in the context of regulation of
termination rates and of next generation access networks. Comprehensive case-law
of the Court of Justice was presented and national court practices were
demonstrated by means of case-law report from the Netherlands. A number of other
issues, such as major notifications under Article 7 in 2009, removal of ex-ante
regulation in the telecoms sector or challenges relating to the digital dividend
were also at stake.
