- On 12 August 2015 the draft had already been notified to the Commission, Directorate-General for Energy, pursuant to Article 33 of the Euratom Treaty.
Nonetheless, it shall also be notified pursuant to Directive 98/34/EC as it summarises a technical regulation that involves waters bottled at their source intended for sale and waters used in food processing businesses for the manufacture, treatment, preservation or marketing and sale of products or substances intended for human consumption (Article 2(1)(a)).


8. Osnovni sadržaj
The draft comprises 13 articles and 3 annexes.
The first three articles identify the objective of the measure, the definitions used, the scope of its application and possible exemptions. Articles 4, 5 and 6 set out the general supervisory obligations imposed on the autonomous regions and provinces, the parametric values and points of compliance, the criteria and procedures for the performance of external inspections and the transmission of results to the Ministry of Health and the obligation of the managers to undertake internal inspections and to keep those results for at least five years. Article 7 indicates the measures to be adopted in case of non-conformity with the indicator parameters and the information and advice to provide to the affected population. Article 8 provides for a Ministry of Health decree to set the technical-operational procedures and instructions for application of the legislative decree. Article 9 governs the substitutive powers of the state in case of breach by the autonomous regions and provinces. Articles 10 to 13 set out the sanctions and the subjects responsible for their application, the financial provisions and the terms for the measure to come into force.
The annexes contain specifications relating to:
Annex I - Parameter values for radon, tritium and indicative dose (ID) for water intended for human consumption.
Annex II - Checks for radioactive substances;
Annex III - Checks for the indicative dose and characteristics of analytic performance.


9. Kratka izjava o razlozima
The draft legislative decree notified was prepared for the implementation of Council Directive 2013/51/EURATOM of 22 October 2013.
Annex I, part C of Council Directive 98/83/EC of 3 November 1998, on the quality of water intended for human consumption, sets out indicator parameters for radioactive substances and provisions for their control. Nonetheless, these parameters fall within the scope of the basic regulations as set out in Article 30 of the Euratom Treaty. Therefore, the directive adopts requirements for checking the level of radioactive substances in waters intended for human consumption through a specific legislative instrument with the objective of ensuring the uniformity, consistency and completeness of the radioactivity protection legislation pursuant to the Euratom Treaty.
Therefore, Directive 2013/51/Euratom shall substitute the provisions of Directive 98/83/EC as concerns the requirements for the protection of the health of the population from radioactive substances found in water intended for human consumption.
The provisions in the draft shall replace the table on RADIOACTIVITY, including notes 8, 9 and 10, in Annex I part C of Legislative Decree 31/2001, providing all of the parameter value specifications, inspections, frequency, characteristics of analytic performance, but, especially, providing risk assessment and management procedures.
The requirement provided for by paragraph 4 of Article 6 was introduced in compliance with the latest amendment to Annex II of Directive 98/83/EC, which imposes the accreditation of the testing laboratories that perform the analyses of water intended for human consumption.
