8. Main Content
This draft Ordinance serves to implement Directive (EU) 2015/2193 of the European Parliament and of the Council of 25 November 2015 on the limitation of emissions of certain pollutants into the air from medium combustion plants, OJ L313, 28.11.2015, p. 1 - hereinafter: MCP Directive. Furthermore, suggestions based on practical implementation should be taken into account.
The basic provisions for implementing the requirements of the MCP Directive have already been established with the amendment of the Carinthian Heating Systems Act, Provincial Law Gazette No 21/2018. The draft Ordinance serves to specify and provide detail regarding the legal requirements and to adapt the terminology to EU law and the requirements of the MCP Directive.


9. Brief Statement of Grounds
Section 1 of the draft Ordinance contains further requirements for the placing on the market of heating equipment with a nominal heat output of up to 400 kW. The Section regarding the placing on the market needed to be amended as national regulations have already been rendered obsolete due to the entry into force of regulations under EU law or will be replaced by such regulations over the next few years. Parameters or limit values which are not specified under EU law will remain valid.
Section 3 contains emission limit values for operation. Before, firing installations were divided into firing installations with a nominal heat output of less than 50 kW and those with a nominal heat output from 50 kW to 2 MW. This division was deleted in order to align the provincial Firing Installations Ordinance [Feuerungsanlagenverordnung - FAV] to the MCP Directive and the present draft Ordinance.
Furthermore, the limit values were converted for solid fuels with an oxygen content of 6 % (in line with the MCP Directive). Moreover, the previous limit values for CO in heating equipment for solid fuels have been regarded as no longer up to date and have therefore been slightly lowered. The limit values were reduced taking into account international standards and the new power limitation of the current 100 kW fuel heat output instead of the previously valid 50 kW nominal heat output.
