Ministry of the Environment Decree on the fire safety of buildings


6. Products Concerned
This decree shall also apply to the construction of new buildings, building extensions or an increase in floor area. It shall also apply to repair and renovation work if the fire safety of a building or part thereof is adversely affected as the result of repairs or renovations, and if improving the fire safety of a building is justified by repair and renovation work, taking into account the prevention of personal safety risks.

8. Main Content
Pursuant to § 117 b of the Land Use and Building Act (132/1999), detailed rules concerning the fire safety of buildings as regards the construction of new buildings, their repair, maintenance and renovations as well as a change in intended use may be issued by a Ministry of the Environment decree regarding:
1) restriction of the ignition and spread of fire, as well as the fire safety of building technology and heating equipment;
2) load-bearing capacity of buildings in a fire and the properties of construction products related thereto;
3) restriction of the development and spread of fire and smoke, and the properties of construction products related thereto;
4) evacuation safety and safety reports;
5) organisation of fire-extinguishing and rescue tasks.

Pursuant to § 117 b, a construction company shall take care that a building is designed and built for fire safety according to its intended use. The ignition risk must be limited. The load-bearing parts of a building shall be such that they hold up for the minimum time in the event of a fire, taking into account the building collapse, safe evacuation, rescue work and control of the fire. It must be possible to limit the development and spread of fire and smoke in the building as well as the spread of the fire to neighbouring buildings. When constructing the building, products and technical equipment suitable for fire safety shall be used. A building shall be built in such a manner that, in the event of a fire, individuals can escape or be rescued. The safety of rescue personnel shall be taken into account in the design. The licensing authority may require the creation of a safety report regarding the evacuation in challenging locations.


9. Brief Statement of Grounds
All parts of the National Building Code of Finland will be revised by the end of 2017 to comply with the current basic law. The binding provisions and implementing guidelines will be separated more clearly than is currently the case. Fire safety is currently regulated by Ministry of the Environment Decree No 3/11 of 6 April 2011. The annex thereto contains the building regulations and guidelines regarding the fire safety of buildings (RakMK E1). In addition, the Ministry of the Environment Decrees lay down Guidelines E2 (22 March 2005), E4 (22 March 2005), E7 (18 June 2003) and E9 (22 March 2005).
A Ministry of the Environment decree on the fire safety of buildings would be based on the provisions on the aforementioned regulations and guidelines. The aforementioned decrees will be repealed at the end of 2017.

I would like to propose some improvements for this decrees as the member of the Finnish and European standardization Bodies, the subcommittee CEN/TC191/SCI Smoke and heat control systems. The proposals are written as the red texts.

 

§ 2

 

Definitions

 

 

 

REGARDING THE DEFINITION 29

 

a) smoke and heat control system refers the arrangement of components installed in a building to limit the effects of smoke and heat from a fire

b) smoke and heat exhaust system refers to the systems that exhausts smoke and heat from afire in a building or part of a building

c) smoke and heat exhaust ventilation system refers to the system in which components are jointly selected to exhaust smoke and heat in order to establish a buoyant layer of warm gases above cooler, cleaner air 

The correspondent definitions in the Pr CEN/TR 12101-12 are:

smoke and heat control system 

arrangement of components installed in a building to limit the effects of smoke and heat from a fire

smoke and heat exhaust system

smoke control system which exhausts smoke and heat from a fire in a building or part of a building

smoke and heat exhaust ventilation system SHEVS

ventilation system in which components are jointly selected to exhaust smoke and heat in order to establish a buoyant layer of warm smoke above cooler, cleaner air

FIRE TECHNICAL INSTALLATIONS

Smoke and heat control systems

 

The premises must be provided with the suitable automatically or manually actuated smoke and heat control system to improve fire safety, where this is required on justified grounds in the safety report. In that case the fire safety of the building must be designed based on a design fire scenario according to § 3 in this Degree and constructed by using the special smoke and heat control installations. 

 

Chapter 8

 

ORGANISATION OF EXTINGUISHING AND RESCUE OPERATIONS

 

 § 42

 

Smoke and heat control

 

In order to enhance the efficiency of extinguishing and rescue operations, means shall be designed and constructed in a building for smoke and heat control that is suitable for the different premises of the building. 

 

 

§ 42 a

Smoke and heat exhaust from premises which different use

 

If the fire safety of the building will be met requirements set in accordance with the classes and numerical criteria set out in this Decree, the smoke and heat exhaust may be arranged by using the windows located in the upper part of the rooms and that are easy to open or by using the comparable smoke exhaust arrangements. 

 

§ 42 b

Smoke and heat exhaust from exit routes

 

Means must be arranged for the extraction of smoke from a fire-separated exit and a fire-separated lift shaft, and for the flow of replacement air.

 

Means shall be provided for smoke extraction from the spaces of the basement storey, so that it will not be necessary to use fire-separated exits or fire-separated extinguishing routes for smoke extraction.

 

 

 

§ 42 c

 

Smoke and heat control system

 

The premises must be provided with the suitable automatically or manually actuated smoke and heat control system to improve fire safety, where this is required on justified grounds in the safety report. In that case the fire safety of the building must be designed based on a design fire scenario according to § 3 in this Degree and constructed by using the special smoke and heat control installations.  

If so required on justified grounds, the premises shall be provided with the proper smoke and heat control systems which can actuated automatically or manually. In that case shall be used the special smoke control installation, which can actuated automatically or manually
