The Act introduces an obligation for providers of publicly available telecommunications services to store certain traffic data for a period of four weeks (location data) or ten weeks (communication data) and lays down guidelines which are designed to ensure the security of the stored data.

9. Brief Statement of Grounds
Since the German Act transposing Directive 2006/24/EC has been declared invalid by the Federal Constitutional Court (judgment of 2 March 2010, Decisions of the Federal Constitutional Court 125, 260), no obligation exists in Germany for providers of publicly available telecommunications services to store their customers' traffic data. In order to close loopholes in terms of protection as regards prosecution and to protect against threats, the Act introduces such an obligation. It makes use of the authorisation under Article 15(1) of Directive 2002/58/EC and transposes the stipulations of the Court of Justice of the European Union (judgment of 8 April 2014).

Additional expense shall arise for the providers of publicly available telecommunications services as a result of fulfilment of the storage obligation provided for in the Act and the associated provisions concerning use of the data, the guaranteeing of data security and data quality, the logging of access to the data and the inclusion of certain information in the security concept to be drawn up. This cannot be quantified at present. See in particular pp. 3 et seq. and 31 et seq. of the draft.
