This draft regulation constitutes the performance of the authorisation under Article 3a(2) of the Act of 25 August 2006 on the fuel quality monitoring and control system (Journal of Laws of 2014, item 1728. In line with the aforementioned delegation, the Minister of the Economy was obliged to define (by way of Regulation) the quality requirements for solid fuels, bearing in mind the state of technical knowledge in this respect stemming from tests performed on these fuels, as well as experience in their application, with particular emphasis on reducing greenhouse gas emissions.
The draft specifies the quality requirements for solid fuels earmarked for use in power stations and industrial plants, as well as by small customers representing the municipal and household sector. The parameters of solid fuels apply both to solid fuels sold in bulk or bagged.
The submitted draft regulation meets the authorisation on quality requirements for solid fuels.


9. Brief Statement of Grounds
This draft regulation aims to establish quality requirements for solid fuels; currently, these are not legally regulated. However, they are necessary for the proper functioning of the fuel quality monitoring and control system.
The main effect of the entry into force of this regulation will be to monitor and control the quality of solid fuels in keeping with the state of technical knowledge and experience in their application, with particular emphasis on reducing greenhouse gas emissions.
Another effect of the proposed solution would be to organise the solid fuel market and enable consumers to obtain information on the quality of fuel sold, based on the possession by manufacturers of the qualitative characteristics of the marketed solid fuels.
