Suppliers of pay-per-view TV shall be covered by an obligation pursuant to Chapter 5, section 3 in the appended Bill to record and to preserve programmes. Such recordings must be sent, free of charge, to the Swedish Broadcasting Authority, the Office of the Chancellor of Justice and the Consumer Ombudsman at the request of each authority. Suppliers of pay-per-view TV who, intentionally or through neglect, fail to record and preserve pay-per-view TV programmes shall be fined or imprisoned for up to one year. They shall not be judged liable in trivial cases. Suppliers of pay-per-view TV may be directed on penalty of a fine to hand over recordings to the Swedish Broadcasting Authority or to the Consumer Ombudsman.

The regulations are scheduled to enter into force during the first quarter of 2016.


9. Brief Statement of Grounds
The purpose of the Bill is to ensure that the abovementioned authorities have access to pay-per-view TV programmes.
Draft technical regulations shall be notified to the Commission in accordance with Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society services.

The Swedish Broadcasting Commission (GRN), which is a separate decision-making body at the Swedish Broadcasting Authority, monitors (by means of retrospective review) whether programmes broadcast via TV or sound radio or made available via pay-per-view TV are in compliance with the Radio and Television Act (2010:696) and the programme-related conditions that may apply to these services.

The primary purpose of the obligation to record programmes under Chapter 5, section 3 of the Implementing Act is to make it possible to take action against breaches of the freedom of expression. With regard to TV broadcasts, the provision also fulfils the objective of securing a basis for the review by the Swedish Broadcasting Commission and the Consumer Ombudsman and for the supervision by the Swedish Broadcasting Authority. The obligation to record programmes pursuant to the abovementioned provision does not currently cover pay-per-view TV. Consequently, it is not possible for the authorities to demand recordings as a basis for their review. The Consumer Ombudsman and the Office of the Chancellor of Justice also need access to recordings for their respective operations.
