Preliminary draft Federal Act on tobacco products and electronic cigarettes (LPTab), 20 pages, available in French, German and Italian.


6. Products Concerned
Tobacco products

Tobacco products include any product comprised of or containing parts of leaves of plants of the genus Nicotiana (tobacco) intended to be smoked, heated, snorted, or used orally - for example snuff - and any plant-based smoking product, including those containing cannabis sativa with a THC content of less than 1.0% (relevant tariff numbers: 2402.1000-2403.9990 and 1211.9000). This new preliminary draft act shall also include electronic cigarettes containing nicotine. Certain provisions shall also apply to objects that form a functional unit with a tobacco product (Articles 17-19 ap-LTab) and to nicotine-free electronic cigarettes (Articles 17-21) (relevant tariff numbers: (i) 8543.7000; (ii) Vaporiser: 8516.7900; (iii) Atomiser: 8543.7000; (iv) nicotine-free e-liquid cartridges: 3824.9098; (v) e-liquid cartridges containing nicotine: 3824.9999).

8. Main Content
The proposal lays down
(i) the requirements applicable to the composition of and emissions from tobacco products and electronic cigarettes containing nicotine. It authorises the marketing of tobacco for oral use (snuff) and electronic cigarettes containing nicotine, which is currently prohibited under Swiss law;
(ii) the packaging requirements for tobacco products and electronic cigarettes containing nicotine, i.e. the packaging, labelling and warnings applicable to these products and the specific requirements applicable to electronic cigarettes containing nicotine and heated tobacco products;
(iii) restrictions on adverts with a particular impact on minors;
(iv) a ban on providing tobacco products and electronic cigarettes, whether nicotine-free or containing nicotine, to minors and the option for the authorities to carry out test purchases;
(v) obligations for businesses, in particular self-monitoring and declarations on the composition of and emissions from tobacco products and nicotine-containing electronic cigarettes. Businesses that manufacture or import heated tobacco products, plant-based smoking products or electronic cigarettes containing nicotine must also issue a notification before placing them on the market.
(vi) the duties of the relevant enforcement authorities and the measures at their disposal, data processing, enforcement financing and penal provisions.


9. Brief Statement of Grounds
The draft act on tobacco products aims to protect human health. Its purpose is to reduce the consumption of tobacco products and limit the harmful effects related to the consumption of these products.
An initial preliminary draft act was already notified to the WHO TBT Committee in May 2014 (G/TBT/N/CHE/176). However, the Swiss Parliament referred the draft to the Federal Council in late 2016 without holding a debate on its contents. This referral included clear instructions concerning the content of the new proposal. This preliminary draft act follows on from the referral.
As outlined when the initial draft LPTab was notified to the TBT Committee in 2014 (G/TBT/N/CHE/176), the new act on tobacco products is necessary owing to the revision of the Federal Act of 9 October 1992 on Foodstuffs and Utility Articles (LDAl, RS 817.0). Under this previous law, tobacco was grouped together with foodstuffs. However, the revised LDAl, which entered into force on 1 May 2017, excludes tobacco from its scope of application after a period of four years. The previous provisions remain applicable to tobacco products over this period, during which a new law specific to tobacco products needs to be drafted. Following the referral of the initial draft by the Swiss Parliament, this period must also be extended.

The preliminary draft act is based on articles 95(1) and 118(2)(a) and (b) of the Federal Constitution (Cst., Classified compilation 101).
