- Regulatory Committees - Standing Committee on Agricultural, Horticultural and Forestry Seeds and Plants

Short report of the meeting held on 22 May 2001.

All Member States present except Luxembourg for point 4a; for the purpose of the vote Luxembourg mandated Belgium.

Iceland and Norway participated as observers.

1. Matters arising from the meeting of the Working Party on seed legislation held on 21 May 2001

The Committee noted in particular the following:

- discrepancies between the Common Catalogues and the national catalogues:

  • varieties excluded from the Common Catalogues;
  • discrepancies subject to a program of corrigendum;

- the first experiences of the Member States in respect of the implementation of the new Commission Regulation 930/2000 as to the suitability of the denomination of varieties.

2. Conditions under which seed of varieties not yet officially accepted may be marketed

Not discussed due to a shortage of time.

3. Temporary experiment on seed sampling and seed testing

Not discussed due to a shortage of time.

4. Adventitious presence of GM seeds in seeds of conventional plant varieties

A continued discussion took place on the plan for co-ordinated and harmonised interim actions by Member States. Further updated information on the actual situation concerning the implementation of such a plan has been provided by the delegations.

The Committee noted that fourteen Member States are currently implementing the plan or are administratively ready to do so. In so far the results are concerned, it was reported that the majority of the samples tested since the last meeting of the Standing Committee have appeared either negative or in a few cases below 0.1 %.

On the occasion the Committee noted documents submitted by the Commission Services on a "protocol for the sampling and detection of GM seed in seed lots", and the records of the meetings of experts held on 24 April and 14 May 2001. The Committee agreed to discuss this matter in depth during its next meeting.

4a Draft Commission Decision providing for the temporary marketing of seed of soya bean not satisfying the requirments of Council Directive 69/208/EEC (request from Italy)

The draft Decision aims to permit for a period expiring on 30 June 2001 the marketing of seed of soya bean subject to less stringent requirements.

Voting: favourable opinion by unanimous vote.

5. Other business

The Committee noted:

- the outcome of a Council meeting held on 29 March 2001 where a common position on the OECD proposal for a voluntary experiment on the validation of GM seed testing was developed;

- a working program in order to develop possible implementing measures to be taken under Council Directive 1999/105/EC on the marketing of forest reproductive material;

- Member States' requests urging the Commission to establish implementing conditions on plant genetic resources;

- a request from Belgium to be released from the obligation to apply, in respect of cotton seed, the provisions of Council Directive 69/208/EEC on the marketing of seed of oil and fibre plants;

- an information supplied by the Commission services on the work in progress in order to align the Commission Directive 72/180/EEC (determining the characteristics and the minimum conditions for examining the varieties of agricultural plants) with the criteria applied in the framework of the Community plant variety rights regime.

N.B: The measures on which the Committee has given an opinion are subject to the appropriate procedure for final adoption by the Commission.
