DPEs operating under specific geographical constraints

Article 9 (1) of Regulation (EC) No 669/2009 provides for the possibility for the competent authority of a certain DPE, which operates under special geographical circumstances, to carry out physical checks as required by the Regulation at approved feed and food business premises. Member States may seek for an authorization by the Commission in this respect. The authorization is granted following assurances by the concerned Member State that the conditions listed in Article 9 (1) of the Regulation are fully met. Following the authorization, a list of feed and food business premises approved under Article 9 (1) is made available by the concerned Member State on the link which lists national DPEs.

To date the following authorizations have been granted by the Commission according to the above provision:

• Commission Decision of 07 June 2010 authorising physical checks pursuant to Regulation (EC) No 669/2009 to be carried out at approved premises of feed and food business operators in Cyprus.
• Commission Decision of 18 August 2010 authorising physical checks pursuant to Regulation (EC) No 669/2009 to be carried out at approved premises of feed and food business operators in Malta.
