Council Decision 90/424/EEC repealed and replaced by Council Decision 2009/470/EC on expenditure in the veterinary field (Codified version) provides for the possibility of a financial contribution by the Community in the eradication and monitoring of certain animal diseases.

Member States may submit eradication, control and monitoring programmes to the Commission, that will consider them from the veterinary and financial angle and check their compliance with the Community criteria relating to the eradication and monitoring of those diseases, in accordance with Council Decision 90/638/EEC, as amended by Directive 92/65/EEC.

As of 1 July 2007, Council Directive 92/40/EEC shall be repealed by Council Directive 2005/94/EC adopting Community measures for the control of avian influenza, which will include also the control of outbreaks of low pathogenic avian influenza (LPAI) caused by avian influenza of H5 and H7 subtypes in poultry. In order to detect the possible circulation of those viruses in poultry flocks, compulsory surveillance programmes have to be implemented in accordance with Article 4 of that Directive. Following the adoption of Directive 2005/94/EC, Council Decision 90/424/EEC has been amended by Decision 2006/53/EC allowing that Community financial assistance may be also granted for those eradication measures carried out by the Member States to combat those LPAI strains known to have the potential to mutate to higly pathogenic avian influenza (HPAI).

Council decision 90/424/EEC has been amended by Council Decision 2006/965/EC to revise the procedures for Community co-financing of animal diseases and zoonoses eradication, control and monitoring programmes and in particular to include the possibility to finance multi-annual programmes that would ensure a more efficient and effective achievement of the objectives of those programmes. In addition, the list of animal diseases and zoonoses eligible for co-financing has been revised as well as the procedure for the approval of the eradication, control and monitoring programmes submitted by the Member States to the Commission as a single Decision approving programmes qualifying for a Community financial contribution replaces the two previously required. Finally, inter-alia, Decision 2006/965/EC provides for the need to update and establish Community criteria for the eradication, monitoring and control of certain animal disease.

Each year, the Commission draws up a decision laying down the list of programmes qualifying for a financial contribution from the Community, and the proposed rate and amount for each programme. The interest of each programme for the Community and the volume of available appropriations are duly taken into account.

In 2008, the Commission adopted rules on the criteria for national programmes (2008/341/EC ), the requirements for submission of programmes (2008/425/EC ) and standard reporting requirements (2008/940/EC ).

The measures provided for in that or those decisions are in accordance with the opinion of SCoFCAH, the Standing Committee on the Food Chain and Animal Health.
