1. Introduction

This metadata information is provided by national authorities to ensure compliance with the requirements of Articles 5 and 7 of Regulation 862/2007 on Community Statistics on Migration and International Protection.

As required by Article 9 of the Regulation 862/2007, Member States must report to Eurostat on the data sources used, the reasons for the selection of these sources and the effects of the selected data on the quality of the statistics. Member States shall provide it with all the information necessary to evaluate the quality, comparability and completeness of the statistical information.

The reference terms for the assessment of quality compliance are provided by Eurostat in the EIL technical guidelines applied for 2014 reference period (See section 3.4 Statistical concepts and definitions from the EIL ESMS file).

 

2. General description of the statistical domain at national level

EIL National System (level of development, main changes that affected the system in the last years and further development)

Gathering and processing data for Eurostat purposes are in charge of Border Guard. This process is coordinated by appointed person in Border Guard Command Centre (BGCC).

 

Legal national framework relevant for EIL statistics

The Head of Border Guard Command Centre (BGCC) is responsible (inter alia) for developing standards, definitions and rules of collection and verification of the data. According to the organizational rules, the tasks of the BGCC include collection, verification and processing of statistical data and information necessary to compile statistics for the Eurostat, as well as specification of the methods of statistical data collection and processing by the organizational units of the Headquarters of the Border Guard and organizational units of the Border Guard

Due to differences in definitions and differences in needs (especially regarding return statistics) there are technical problems with developing IT solutions.

The system of verification of data, collected for EIL purposes, is based on current training of persons, who are responsible for entering the data into the database and the current supervision, also with monthly verification/comparing all records in database in current month, with source documentation (the reports as well as the supplements), describing all the reported cases. During entering the data into the database there is made so called “analysis of all cases”, with connecting of instruction issued by Head of BGCC

The total is broken down betwee:

a)  Detections of illegal stay inland. This includes also persons who were detected for illegally crossing internal borders (= borders between two Schengen Member States),

b) Detections of illegal stay while the third country nationals were exiting or attempting to exit the territory at external borders, either at border crossing points (BCPs) or between BCPs. The category should include third country nationals who are not in the possession of a valid visa, residence permit, travel document etc. or being in breach with a decision to leave the country. It also includes third country nationals who initially entered legally but overstayed their permission to stay

It covers cases, when the obligation to leave is issued in connection with negative asylum decision.
