The regulatory instruments relevant in EU actions against environmental crime: comparative analysis within the framework of the European criminal law

The research aims at stocktaking and analyzing International, European and National instruments relevant in the EU action against environmental crime, also when linked to organized crime. It will be crucial the analysis of legislation, literature and case law on environmental crime as well as on national and transnational organized crime, and the study of scientific journals. The research will be carried out in a comparative perspective, with special regard to French legal order. The research will be conducted in the framework of European criminal law, through the analysis of the implementation of EC directive 2008/99 and 2009/123 as well as through the analysis of article 83 TFEU role in the fight against environmental crime, also in light of the harmonization needs already emerged in other sectors, such as illegal immigration, trafficking in human beings, organized crime.
