http://www.unimib.it/link/news.jsp?5977519371355572581 Neurosciences affect the criminal proceeding and, in particular, law of evidence from at least three points of view. Firstrly, nueurosciences are rilevant for their implications in the admission, taking and assessment of narrative evidence. However, there must also be consideration of the impact of such investigations on the witness' moral fredom and free conviction of the judge. Moreover, neurosciences enable a more accurate verification of the defenndant's imputability and his/her capacity to attend the process consciously. Finally, neurosciences can provide new evidence for a retrial, in line with the latest case law that has allowed for an extraordinary appeal on the basis of consederations arising from so-called 'new scientific' evidence. yet while neusrosciences may be applied in a criminal proceeding, it is necessary to ensure that the judicial decision be understood by all citizens.
