The requirement of clarity and the dialogue between courts with respect to financial markets criminal law

The scope is the assessment of the observance of the requirement of clarity with respect to financial markets criminal law. Part of the doctrine is challenging even the possibility of finding a literal significance of a legal text. The duty of interpretation in conformity with supranational legal sources and the dialogue between courts have brought to the elaboration of the concept of nullum crimen sine lege which also involves case law. Financial markets criminal law is a privileged observatory of such developments due to the derivation of European Law and the vagueness of the elements of offense that need to be supplemented, not only by the courts, but also by the supervisory authority. The project provides for a reconstruction of general problems, also in terms of a comparison with the German legal system, and a subsequent confrontation with the technical standards of typification adopted in the selected area.
