Health as a Social Right: Duties, Rights and Protections

The project addresses the question of how to qualify the right to health both as a social right within a welfare state and as a basic human right guaranteed by international sources that can be brought to bear whenever a state cannot or will not protect it. This question will be investigated from three angles in particular: (a) the conflict between human rights and social rights; (b) the ability to configure the right to health as an entitlement supported by public policy, inclusive of safeguards, guarantees, and social-welfare programmes; (c) the need to rethink accountability and social structures so that they can promote welfare policies focused on the duties of solidarity and social cooperation in contemporary society, especially in the context of public health-care systems.
