Documents on infringements (letters of formal notice and reasoned opinions)

The first two steps in the infringement procedure under Article 258 of the Treaty are known as the "letter of formal notice" and the "reasoned opinion", the third one being the referral to the European Court of Justice.

According to the case law of the Court of Justice, disclosure of these documents is not possible while an infringement case is ongoing. However, they are accessible to the public upon request after the closure of the case by the Commission.

To contribute to transparency and make this information more accessible to citizens and stakeholders, DG Environnement has started to actively disseminate all the documents relating to closed infringement cases.

Cases opened in other years will be published soon.

The legal basis is expressed in the Celex format, so for example 32007L0060 means Directive 2007/60.
