Consultation on Additional input to the commission impact assessment for a review of the scope of provisions of the RoHS 2 Directive pursuant Article 24(1) – Areas of review:
1st area of review: Electric bicycles - Technical and socio-economic considerations concerning a possible exclusion for electric bicycles from the scope of RoHS.
2nd area of review: EEE newly in scope - Technical and socio-economic considerations relevant for assessing the impacts of various possible amendments to Articles 2(2), 4(3) and 4(4).

Objective of the consultation

 

 

The RoHS Directive (2002/95/EC) (RoHS 1) has been recasted and has now become Directive 2011/65/EU that entered into force on 21 July 2011, repealing Directive 2002/95/EC on 3 January 2013. Pursuant to Article 24(1) of the Directive, no later than 22 July 2014, the Commission is to examine the need to amend the scope of the Directive and shall present a report thereon to the European Parliament and the Council, accompanied by a legislative proposal, if appropriate, with respect to any additional exclusions related to that EEE. Two ares have been identified by the EU COM for which additional input is needed towards this end: the one concerning impacts of a possible exclusion for electric bicycles from the scope of RoHS; and the second concerning possible adjustments concerning the transitional arrangement provided for electrical and electronic equipment, that was formerly outside the scope of RoHS 1 but that is now in scope, until 22 July 2019 (see Article 2(2).
