The 98/34 Procedure: a tool at your service


The notification procedure laid down by Directive 98/34/EC is a tool for information, prevention and dialogue. It is at the service of the Internal Market, that is to say at your service, because it can enable you to anticipate and prevent the creation of barriers to trade likely to affect your activities, the activities of your customers or those of your members.

Pursuant to Directive 98/34/EC, as amended by Directive 98/48/EC, Member States are obliged to notify to the Commission draft national technical regulations relating to all products, and draft national regulations specifically concerning information society services.




How do I access notified drafts?

In principle, notified drafts are translated into all Community languages. They are then available to you on the Europa site, via the TRIS database (Technical Regulations Information System).

The TRIS system can be accessed free of charge, with no further formalities, and is updated daily. It allows you to browse the legislative initiatives of the Member States likely to be of interest to you or likely to have repercussions for your activities. In order to aid your search, notified drafts are classed in specific categories and sub-categories, depending on their aim and the area of activity concerned.

What if a project submitted for consultation risks causing problems or creating barriers to my trade within the European Union?

In this case, do not hesitate to issue your opinion or make your grievances known to the Commission or the competent offices in your Member State. Your reaction may be decisive. The 98/34 procedure is transparent and allows the Commission and all Member States to react, on an equal footing, to notified drafts. The aim is to ensure that these texts are brought into conformity with the regulations of the Internal Market.
