The draft Order is based on the Commission Recommendation of 23 July 2003 on guidelines for the development of national strategies and best practices to ensure the coexistence of genetically modified crops with conventional and organic farming (2003/556/EC).
The draft envisages technical requirements relating to the cultivation of genetically modified crops and contains both general provisions and a delegation of authority permitting the Swedish Board of Agriculture to issue administrative provisions.
The draft applies only to cultivation on agricultural land and, in relation thereto, transport, storage or other handling of genetically modified products. It covers neither field tests nor cultivation for private use within the grower’s own household.
The draft sets out requirements pertaining, inter alia, to information relating to certain other land uses, measures for cultivation and transport and the cleaning of machinery, etc. Provisions on areas such as monitoring, fees and penalties can be found in other legislation.
9. Brief Statement of Grounds
The main aim of the draft Order is to regulate precautionary measures for cultivation, etc., so that there is no risk of genetically modified organisms spreading to agricultural land belonging to another party, which would also run the risk of giving rise to economic damage as a result of a need arising to mark products that are not genetically modified.
