Declaration by the European Parliament, the Council and the Commission
With regard to access to cars for disabled people, the European Parliament, the Council and the Commission shall encourage the Member States to take any national measures that are necessary to ensure that all levels of existing buildings and those under construction may be accessible to disabled people, particularly those who use wheelchairs. They shall recommend the provision, in all new buildings, of at least one lift accessible to disabled people in wheelchairs. That lift must fulfil all the requirements for such use (dimensions, position of controls, etc.).
Existing lifts
The safety of existing lifts (that is to say lifts installed before the Lifts Directive came into force) is subject to national regulations. Commission Recommendation 95/216/EC invites Member States to take all necessary actions to ensure a satisfactory level of maintenance for existing lifts and to improve the safety of these lifts. The Recommendation is not legally binding and is implemented by the Member States in light of the situation and provisions existing at national level.
