Why are there different registration fees according to the tonnage range?

This is because the amount of fees has been calculated by reference to the associated workload. The associated workload of registration submissions in the higher tonnage ranges is higher than for the lower tonnage ranges as the amount of information that must be managed and assessed by the Agency increases with higher tonnage ranges.

Reduced fees for intermediates

Why is there a reduced fee for the registration of intermediates?

A reduced fee applies to registration submissions of intermediate substances that benefit from the reduced information requirements contained in Articles 17(2), 18(2), or 18(3) of the REACH Regulation. The reduced level of fees for such submissions is justified because the related workload of the Agency in connection with this type of dossier is lower. In addition, there is no increase of fees according to the tonnage range because the information requirements do not systematically increase according to the tonnage range.

How do I know if I can benefit from the reduced registration fee for intermediates?

The reduced registration fees set out in Annex II of the Fees and Charges Regulation do not apply to registration submissions for intermediate substances that contain the full information requirements set forth in Article 10.

You should read carefully Articles 17(3) and 18(4) to assess if the reduced information requirements apply to you. If you are required to submit a dossier with the standard information requirements of Article 10, the standard registration fees set out in Annex I of the Fees and Charges Regulation will apply to you.

Fee Waiver

When can I benefit from the waiver of the registration fees?

In accordance with Article 74(2) of the REACH Regulation, you do not need to pay a fee for a registration submission in the tonnage range between 1 and 10 tonnes, provided that your registration submission contains all the information requirements set out in Annex VII of the REACH Regulation.

Confidentiality requests

When do I have to pay a fee to request that certain information of my registration submission is kept confidential by the Agency?

The fee to request the confidential treatment of certain information only applies in the context of registration submissions. Specifically, a fee is payable when the registrant requests that the type of information listed in Article 119(2) of the REACH Regulation that is contained in its submission is not published on the Internet by the Agency.

Other requests that are made to the Agency to keep certain information confidential, for example in the context of authorisations, are not subject to the payment of a fee.

It is to be noted that a fee must also be paid if the request is made after the registration submission is made.

Why is there a fee for certain confidentiality requests?

REACH requires the Agency to publish certain information on the Internet. The type of information listed in Article 119(2) of the REACH Regulation, to which the fee applies, should be made available on the Internet unless the party submitting the information requests that it is treated as confidential (provided that this request is justified as required by Article 10(a)(xi) of the REACH Regulation).

The examination of a confidentiality request and the justifications provided will trigger an examination of such a request on its merits; this exercise requires intensive resources at the Agency which will be funded by the fees attached to such requests.

Why are the fees for confidentiality requests payable per item?

A separate fee is levied for each item for which the confidentiality request is made because the fees levied for confidentiality requests must be related to the estimated workload for the examination of such requests. If a confidentiality request is made regarding study summaries or robust study summaries, a fee will be levied for each separate study for which the confidentiality request is made.

Thus, the requirement that a fee is paid per item reflects the fact that the workload of the Agency will depend on the number of items that it has to examine. For instance, in the case of a request to keep confidential certain information in two studies, the work for the Agency will, in normal circumstances, be double that of a request that only refers to one study.

Updates

Do I have to pay fees when I submit updates to my registration submission?

Fees are payable in connection with certain types of updates of the registration submission. Specifically, a fee is payable in the context of updates of the tonnage range; in the context of updates of the identity of the registrant; and in the context of changes in access granted to the information contained in the registration submission.

When do I have to pay for updates in the tonnage range?

REACH requires that, when there is a change in the tonnage range, an update of the submission is made. When a submission is updated to inform the Agency of an increase in the tonnage range, a fee must be paid. In contrast, updates concerning a lower tonnage range do not trigger any fee. This reflects the principle that the level of fees should reflect the workload involved.

The fee is only payable once for the given tonnage range ; this means that if a registrant has already registered for a certain tonnage range, an update that refers to the same tonnage range (following a decrease), will not give rise to the payment of a fee.

When do I have to pay for updates in the identity of the registrant?

A fee is payable when the legal personality of the registrant has changed, for instance following a merger or a take over. The notification to the Agency of changes in the address of the registrant does not give rise to the payment of a fee. Likewise, other changes in the status of the registrant will not give rise to the payment of a fee.

When do I have to pay for updates in the access granted to information in my submission?

Confidentiality requests regarding certain information give rise to the payment of a fee. If a confidentiality request under the REACH Regulation is not made when the registration submission is first made, the Agency will generally publish on the Internet the type of information listed in Article 119(2) that is contained in the submission. Therefore, in most cases, a late request for confidentiality would not really serve to protect the confidentiality of the information at stake.

Nevertheless, there may be cases in which a registrant still wants to make a confidentiality request after the registration submission has been made. Those requests will trigger the payment of a fee (per item), as set out in Annex III of the Fees and Charges Regulation.

Updates requesting the Agency to consider information that was previously held confidential by the Agency (following a confidentiality request) be no longer considered as confidential are free of charge.
