Directives and regulations - Exemptions for end-of-series vehicles
Background
Framework Directive 70/156/EEC
covers in its Article 8(2)b special provisions for end-of-series vehicles:
- Within the limits contained in Annex XII, section B and for a limited period Member States may register and permit the sale or entry into service of new vehicles conforming to a type of vehicle whose type-approval is no longer valid under Article 5 (5).
This provision shall apply only to vehicles which:
- were in the territory of the European Community; and
- were accompanied by a valid certificate of conformity which had been issued when the type-approval of the vehicle in question was still valid, but which had not been registered or put into service before the said type-approval lost its validity.
This option shall be limited to a period of 12 months for complete vehicles and 18 months for vehicles completed as from the date on which the type-approval lost its validity.
The Article states that the Member States shall each year send the Commission a list of exemptions granted.
