Background informationIn July 2008, Council and the European Parliament adopted the New Legislative Framework (NLF), a set of measures enhancing the functioning of the internal market in goods. The NLF consists of two complementary instruments, Regulation 765/2008/EC on accreditation and market surveillance and Decision 768/2008/EC establishing a common framework for the marketing of products.
Both instruments have the objective to address a number of problems which have been generally observed throughout various industrial sectors regulated by “EU technical harmonisation legislation”, i.e. legislation that sets up common requirements for the marketing of products. The main concern is to ensure the safety of citizens and to reduce the number of products on the market which are not satisfying the requirements set out in EU legislation. Another objective is to improve the quality of the work performed by bodies active in testing and certifying products. Furthermore the NLF should also bring more consistency into the whole regulatory framework for products and simplify its application.
Regulation 765/2008 has become applicable on 1 January 2010. Decision 768/2008 does not have legal effects for enterprises, individuals or Member States. It is designed to work as toolbox containing those provisions which are common elements of technical harmonisation legislation. These standardised provisions should be integrated into new and revised legislation. For this reason the Commission has envisaged to align ten directives to the new standards set by Decision 768/2008.
