Objective of the consultation

To evaluate the application of the Data Retention Directive by Member States further to Article 14 of that Directive requires that the Commission carries out an evaluation that should also include the impact of the Directive on economic operators and consumers, taking into account further developments in electronic communications technology and statistics that Member States provided.

How to submit your contribution

The Commission drafted together with the expert group "the platform on electronic Data Retention" that was established by Commission Decision 2008/234/EC of 18 March 2008, a comprehensive Questionnaire for the attention of all relevant stakeholder groups: Member states, the European Pariament and Civil Society, Data Protection Authorities and Industry. The questionnaire was presented to Member States on 10 September 2009 that undertook to comment until 21 September. It was sent to the relevant stakeholders on adopted on 30 September 2009, with the request to provide their contribution until 21 December 2009.

+/- 70 - some responses sent in by Member States include the responses of a number of authorities, including sometimes data protection, and of a smaller or larger number of national telecommunication service or network operators.
