Objective of the consultation

The European Commission is consulting the public in view of presenting a proposal for a Council regulation to establish a Visa Information System (VIS). Please answer the series of questions available in English, French and German at the bottom of this page and send your comments by e-mail to JAI CONSULTATION VIS. You can also answer directly via the Interactive Policymaking tool. The proposal will define the system and its operation, including the categories of data to be entered into the system, the purposes for which they are to be entered and the criteria for their entry, the rules concerning the content of VIS records, the rights of access for authorities to enter, update and consult the data and rules on the protection of personal data and their control. It will be subject to an extended impact assessment, taking into account horizontal multi-sectoral (economical and social in particular) aspects.

The Council has decided to establish a Visa Information System (VIS). It adopted conclusions for the purpose and the structure of the VIS on 19th February 2004. According to these conclusions, VIS will be a system for exchanging visa data between Member States. It will have to meet the following objectives:

  1. constitute an instrument to facilitate the fight against fraud, by improving exchanges of information between the Member States (at consular posts and at border crossing points) on visa applications and responses thereto;
  2. contribute to the improvement of consular cooperation and to the exchange of information between central consular authorities;
  3. facilitate checks that the carrier and the holder of the visa are the same person, at external border checkpoints or at immigration or police checkpoints;
  4. contribute to the prevention of "visa shopping";
  5. facilitate the application of Council Regulation (EC) No 343/2003 determining the State responsible for examining applications for asylum;
  6. assist in the identification and documentation of undocumented illegal migrants and simplify the administrative procedures for returning citizens of third countries;
  7. contribute towards improving the administration of the common visa policy and towards internal security and to combating terrorism.

On the basis of the political orientations and objectives set out by the Council and the results of an extended impact assessment, the Commission will present a proposal concerning the establishment of the VIS that will define in particular the system and its operation, including the categories of data to be entered into the system, the purposes for which they are to be entered and the criteria for their entry, the rules concerning the content of VIS records, the rights of access for authorities to enter, update and consult the data and rules on the protection of personal data and their control.

According to the Commission's communication of 5 June 2002 on impact assessment (COM(2002) 276 of 5.06.2002), and on the basis of a preliminary impact assessment the Commission decided in the Annual Work Programme 2004 that the Proposal for a Council Regulation concerning the establishment of the Visa Information System should be subject of an extended impact assessment.

Due to the significant crosscutting impact and the high political significance of this proposal, the Commission decided that horizontal multi-sectoral aspects, in particular economical and social, shall be taken into account as soon as possible in the process.
