 New rights for air passengers: deal is done

Loyola de Palacio, European Commission vice-president in charge of transport and energy, welcomed the 15 October early morning agreement in the conciliation committee on the proposal of regulation to protect the rights of air passengers when facing denied boarding, cancellation of their flight or a long delay. "This is a big step ahead in our effort to put the citizens at the heart of EU policies” she said. “Too many times, air passengers are victims of practices which deserve that they receive a fair treatment and proper compensation: the today's agreement paves the way for completing and strengthening the existing rights.” she added. The Council and European Parliament plenary session must definitively confirm the conciliation agreement, and the regulation should enter into force at the beginning of 2004. Loyola de Palacio concluded: “As we did in the past, the European Commission will ensure that the passengers are informed of their new rights and a proper information will be given in all airports”.

 Rail infrastructure package: Commission refers 9 Member States to the Court of Justice

The Commission is bringing on 16 October 9 Member States in front of the Court of Justice for failing to notify the Commission of any transposition of the rail infrastructure package opening the market for international rail freight services. The transposition of this set of three directives into the national legal framework should enable more efficient and on-time cross-border operations needed by rail to compete with road. The Commission will fully play its role in ensuring a European level playing field.

Commission refers the UK to the Court of Justice for failing to apply Euratom Treaty requirements on radioactive waste

Failure to consult the Commission before authorising the disposal of radioactive waste from the Devonport Dockyards Ltd (DML) nuclear installation will result in the United Kingdom's referral to the Court of Justice, the Commission decided on 16 October.

Marine equipment : Commission sends reasoned opinions to six Member States

The European Commission has sent on 16th October reasoned opinions the last step before a formal complaint to the Court of Justice - to Italy, Portugal, Austria, Luxembourg, Greece and Finland for failure to respect EU legislation on marine equipment. The aim of the infringed legislation is to enhance safety at sea and to prevent marine pollution through the uniform application of international instruments relating to equipment to be placed on board EU ships. The Commission has decided to send reasoned opinions to Italy, Portugal, Austria, Luxembourg, Greece and Finland for failing to communicate national measures transposing a 2002 Directive laying down quality requirements and testing standards for equipment to be placed on board a Community ship. Member States had to adopt the necessary legislation before 23 March 2003.

Maritime safety: the Commission takes five Member States to the Court of Justice (FR)

The Commission decided on 16 October to seize the Court of Justice with the cases against Belgium, Greece, the Netherlands and Finland for non-respect of community legislation on fishing vessels. It also decided to request the Court to condemn the Netherlands and Austria for non-communication of national measures to transpose the directive on port installations for waste from ships and cargoes.

Road Transport - enforcing drivers' hours : Commission sends reasoned opinion to Portugal

The European Commission has sent on 16 October a reasoned opinion the last step before a formal complaint to the Court of Justice - to Portugal for failure to respect EU legislation on enforcing road transport drivers' social legislation. The aim of the infringed legislation is to ensure a minimum level of enforcement of drivers' hours is maintained in every Member State to prevent unfair competition within the sector, improve road safety and working conditions for drivers. The Commission has decided to send this reasoned opinion to Portugal for failing consistently to meet the minimum number of checks of days worked by professional drivers each year for the period from 1995 to 2000. Directive 88/599/EEC requires Member States to check at least 1% of all days worked by professional drivers, and a minimum of 15 % of such checks to be at the roadside and 25% at the premises. Portugal continues to provide insufficient enforcement activities by failing to meet this minimum requirement its own statistics provided biennially for the regular Commission reports on the implementation of the driving time legislation show that for 1995-96 it checked 0,38%, for 1997-98 0,39% and for 1999-2000 0,66%. Unlike the other Member States that already check above the minimum requirement, Portugal has still to meet its obligations.

 Commission sets out its policies for Europe's aerospace industry

The European Commission has presented on 15 October a Communication on aerospace which identifies the steps needed to improve the political and regulatory framework affecting the competitiveness of this key industry in several important areas. With this Communication, the Commission is responding to the analyses and prescriptions of the STAR 21 report (Strategic aerospace review for the 21st Century) presented by the European Advisory Group on Aerospace in 2002.

Probe on modified aid package in favour of Alstom

On 26 September France communicated a new aid package in favour of Alstom. This aid package replaces the earlier aid package on which the Commission launched a formal State aid probe on 17 September 2003. On 15 October, the Commission extends this probe in order to include additional aid measures of € 1.1 billion that were not covered by the probe of 17 September.

The Commission authorises Dutch aids to its airlines following 11 September

The Commission on 15 October decided not to oppose the payment, already made by the Netherlands, of EUR 26.1 million to the national airlines following the closure of airspace from 11 to 14 September 2001. The Commission's decision is fully in line with its Communication of 10 October 2001 on "The repercussions of the terrorist attacks in the United States on the air transport industry"'1. The Commission had accepted in this Communication that some types of aid, including aid for insurance and losses suffered through the closure of airspace, or "aid to make good the damage caused by natural disasters or exceptional occurrences" (in the words of the EU Treaty), could be granted to the air transport industry by way of exception.

Rail interoperability: the Commission sends Reasoned Opinions to eight Member States

The European Commission has commenced on 16 October legal proceedings against eight member states that have not notified it of measures to transpose into their national law the Directive on interoperability of conventional railways. The Directive is designed to facilitate the circulation of trains on the trans-European network and aimed ay creating a real internal market for rail equipment and services. The eight countries that have not communicated their measures taken to transpose the European legislation into their national laws are Austria, Germany, France, Greece, Ireland, Italy, Sweden and the United Kingdom. The procedure, which could lead to the European Court of Justice, concerns the non-respect of the deadlines for notification of transposition measures to the Commission. Directive 2001/16/EC, adopted 19 March 2001, on the interoperability of conventional railways, should have been transposed into national legislation by 20 April 2003 at the latest. The Directive, as with that related to high speed lines, establishes community procedures for the preparation and adoption of common technical specifications as well as common rules for the evaluation of conformity with the specifications.
