Chemical

The pH test carried out by Regional Environmental Protection Agency revealed levels that were significantly lower than the classification limits laid down for corrosive preparations. The information provided on the label and on the safety data sheet does not reflect the real danger posed by the product. The product poses a chemical risk and, since it is corrosive, can cause serious burns. The toxicological information on the safety data sheet states that it can cause slight skin irritation after prolonged contact.

The label contains the irritant symbol rather than the corrosive symbol, and the specific risk phrases are not shown. The pH test revealed levels (1.08 ±0.08) that were significantly lower than the classification limits laid down for corrosive preparations (pH = 2).

In one case of accidental swallowing, the label was of no help whatsoever. Indeed, it could have led the doctor at the poisons unit to take incorrect action. Fortunately, this was not the case thanks to the intuition of the doctor, who immediately suspected the error on the label.

Fire

This product poses a serious risk of fire because the Electric Cooling Fan control unit's metal cover may not have the specified corrosion protection. If this is the case, the metal cover will experience an accelerated corrosion process, which may lead to moisture ingress and electrical malfunction. Electrical malfunction of the cooling fan may result in high engine temperature generating a warning message in the Driver Information Module, high engine temperature shown in instrument gauge, the cooling fan continuously running or in extreme cases complete failure of the cooling fan. In the worst case scenario the condition may lead to a short circuit in the electrical fan unit and a local overheating of it. Should this occur it might initiate a fire in the engine bay. During driving the driver may in such case notice smoke and/or smell. Furthermore, the firewall between the passenger compartment and the engine bay is designed to help provide the driver with sufficient time to handle the vehicle to a safe stop and evacuate the vehicle. However, since the fan is permanently connected to battery voltage a fire may occur also on a parked vehicle, both in key-on and key-off position. Therefore, there is a risk of potential fire spreading beyond the engine bay and the vehicle itself.

Injuries

This product poses a serious risk of injuries due to vibration at the mounting location of the bank angle sensor, which, if combined with the misrouting of various wires that impinge on the sensor or its pigtail, can compromise the isolation of the bank angle sensor. Under certain circumstances, this may create a false “tip” signal and cause the engine to quit while an operator is riding the motorcycle. This could result in an accident, which could cause injury or death to the rider.

Enforcement is a top priority of the EU Consumer Policy Strategy 2007-2013. Both measures leading to RAPEX notifications and measures which come to the attention of the Commission and other Member States as reactionsare indications of enforcement activity in the Member State concerned.

In order to give a better view on the overall level of enforcement, including the follow-up activities of the national market surveillance authorities, the Commission RAPEX team has decided to publish on the RAPEX website also the names of the countries that have found the notified product on their market and have taken appropriate measures (and have submitted a reaction to a RAPEX notification as a consequence).

Information about the reacting countries is available in the RAPEX weekly overviews in the column 'Products were found and measures were taken also in'. The Commission RAPEX team will publish reactions sent (from May2009 onwards) to 2009 RAPEX notifications.
