This product poses a risk of cuts to children because polymer materials of the letters contain sharp points. The sharp points could cause cuts among the children using it. While the injuries children may suffer are in principle minor, the possibility of them to occur is high due to the fact that playing with the toy involves handling all the pieces. The product poses a risk of injury because metal hooks straighten out causing the elasticated strap to recoil at high velocity.

During testing, all single length straps failed the force requirement (400N for 60 seconds) as defined in the relevant British standard due to a combination of pull-through and hook failure. In addition, the markings and instructions for use are insufficient. The packaging states ‘Do not exceed 170N Tension’ when the standard requires that elasticated straps should sustain 400N Tension for 60 seconds. Similar products have in the past caused serious eye injuries.

Injuries

170 complaints regarding the small magnets coming out of these recalled toys have been reported. There were three reports of serious injuries to children who swallowed more than one magnet. All three suffered intestinal perforations that required surgery.

Risk of internal injuries. Tiny Magnets inside the dolls and accessories can fall out undetected to parents and guardians. The magnets can be swallowed, aspirated by young children or placed by a child in their nose or ears. When more than one magnet is swallowed, the magnets can attract to each other and cause intestinal perforation, infection or blockage, which can be fatal. Aspiration to the lungs requires immediate surgery. Magnets placed in the nose or ears can cause swelling and be difficult to remove.

Enforcement is a top priority of the EU Consumer Policy Strategy 2007-2013. Both measures leading to RAPEX notifications and measures which come to the attention of the Commission and other Member States as reactionsare indications of enforcement activity in the Member State concerned.

Information about the reacting countries is available in the RAPEX weekly overviews in the column 'Products were found and measures were taken also in'. The Commission RAPEX team will publish reactions sent (from May2009 onwards) to 2009 RAPEX notifications.
