Injuries

Due to a defective weld, the tie-rod assembly for the rear-wheel suspension may break, resulting in loss of control of the vehicle and risk of an accident and injury.

A weld on the tie-rod assembly for the right rear-wheel suspension does not meet the specification. The assembly could therefore break at this point, with the result that the right rear wheel would no longer be steered correctly and the driver would loose the control of the vehicle.

The product poses a risk of allergy due to excessive nickel content in the buckle: 3.3 micrograms/cm2/week whereas the maximum release rate for nickel is set at 0.5 micrograms/cm2/week. The buckle is greatly in excess of this limit despite the labelling “nickel-free metal parts”. The presence of nickel in products which are in immediate and prolonged contact with skin can cause sensitization and allergic reactions.

Voluntary measures: Voluntary withdrawal from the market and recall from consumers.

Electric shock

- the electric resistance is not properly insulated;

- the power supply cord is not connected to an earth conductor;

- the product does not satisfy the Class II requirements. Therefore, water from body perspiration could enter into live components resulting in a clear risk of electric shock.

This product does not comply with the Low Voltage Directive and the European Standard EN 60335.

One instance of personal injury has been reported.

Compulsory measures: Withdrawal from the market, recall from consumers and destruction ordered by the authority.

Chemical

This product poses a chemical risk because it contains more than 0,1% of one or more ethers of phthalic acid (detected value 0,5 %). Detected value of DINP is 5000 mg/kg.

Phthalates have a negative effect on the development of male/female reproductive organs. Especially children are vulnerable as their body is developing and can be negatively affected by these toxic substances.

Compulsory measures: Sales ban pending corrective action ordered by the authority.

Enforcement is a top priority of the EU Consumer Policy Strategy 2007-2013. Both measures leading to RAPEX notifications and measures which come to the attention of the Commission and other Member States as reactionsare indications of enforcement activity in the Member State concerned.

In order to give a better view on the overall level of enforcement, including the follow-up activities of the national market surveillance authorities, the Commission RAPEX team has decided to publish on the RAPEX website also the names of the countries that have found the notified product on their market and have taken appropriate measures (and have submitted a reaction to a RAPEX notification as a consequence).

Information about the reacting countries is available in the RAPEX weekly overviews in the column 'Products were found and measures were taken also in'. The Commission RAPEX team will publish reactions sent (from May2009 onwards) to 2009 RAPEX notifications.
