Danger for small children - the lighter shapes identified above (which according to EN 13869 comply with the definition of a novelty lighter) can attract children younger than 51 months of age, which leads to increased chances of burning or fire risk.

The drive chain and sprocket were unguarded and presented a trapping and contact hazard to the user. The fuel system and electrical circuits were inadequate causing possible fire hazards.

The bike failed to comply with the Standard BS 7407 in a number of aspects:

- The drive chain and sprocket were not adequately guarded.

- The construction of the bike was of a poor standard, with inadequate welding and low grade nuts, bolts and screws used on engine mounting, brakes, transmission and steering.

- There was no fuse system to protect the electrical circuit.

- The fuel tank had no shielding from heat sources such as the engine.

- The handlebar stop button appeared inadequate.

- An effective speed limiting device was not evident.

- The brake levers were not ball ended.

- The rear mudguard was inadequate and did not extend to the vertical tangent of the wheel.

Compulsory measures: Suspension from sale by the authority. (Importer signed over the bikes to the local authority for disposal).

This mini-motorbike poses a risk of injury because the drive chain and sprocket were unguarded and presented a trapping and contact hazard to the user and because of steering and braking deficiencies.

A potential fire hazard exists due to inadequacies in the fuel system.

The bike failed to comply with the Standard BS 7407 in a number of aspects:

- The drive chain and sprocket were not guarded. - The braking system was insecurely attached, operated abnormally and was imbalanced and inefficient.

- The machine did not have a suspension system, which in certain conditions would affect the handling characteristics.

- The steering mechanism fouled on the fairing and did not have full freedom of movement.

- There were sharp edges, trapping hazards and mis-alignment of the fairing.

Compulsory measures: Suspension from sale by the authority. (Importer signed over the bikes to the local authority for disposal).

This product poses a risk of injury (falling, trapped/jammed body parts) due to the insufficient structure of the chair. In particular,

- due to chair’s insufficient balance, there is a risk of the chair falling backwards and thus injuring the consumer;

- given that hollow pipes are not covered, consumer can trap his fingers inside the pipes;

- the construction of the chair does not guarantee durability and proper strength for performing seats and the backs’ support broke during a fatigue test. There is therefore no guarantee that chair will not fall back, to the sides or to the front.

During strength, durability and stability test, table tumbled down when work top was affected by 110 N strength whereas according to the requirement, table has to be stable when affected with strength of less than 200 N.

In a centrifugal test, the cutting discs failed well below the minimum fracture speed of 150 m/sec prescribed by the relevant standard. Cracks radiating from the metal ring are apparent on the front of the disc.

The indications of intended use are contradictory, the mention of use for stone being accompanied by a pictogram for steel, which is not permissible.

In addition the product had incorrect labelling.

Drowning

The housing for the cover and diaphragm of the affected units were manufactured with a material that could deform over time, causing the cover of the regulator to come loose and the diaphragm inside the regulator to become dislodged. If the regulator is exposed to sufficient heat for a prolonged period of time, housing deformation would be accelerated. In the event the diaphragm dislodges in water, air flow will be interrupted and the regulators will no longer function, posing a drowning hazard to users.

Release of phthalates

This product contains a preparation which is not permitted for public use due to its toxicity.

The coloured phase of this product consists mainly of dibutylphthalate (CAS 84-72-4) which is classified as toxic for reproduction (development) (category 2), very toxic to aquatic organisms and toxic for reproduction (fertility) (category 3).

In addition, the decree of 07/08/1997 prohibits the marketing of this substance or of preparations containing a sufficient quantity of the substance.

Compulsory measures: Withdrawal from the market and recall from consumers ordered by the authority.

Enforcement is a top priority of the EU Consumer Policy Strategy 2007-2013. Both measures leading to RAPEX notifications and measures which come to the attention of the Commission and other Member States as reactionsare indications of enforcement activity in the Member State concerned.
