CONTEXT

No action at EU level
Possibility of an additional laboratory test
Different treatment of a product by different Member States as a result of different test results could be eliminated by a test carried out by another laboratory agreed upon by the market surveillance authorities concerned. The choice of the testing laboratory could be left to the national market surveillance authorities without any involvement of the Commission. The outcome of this laboratory test would be binding on the market surveillance authorities by virtue of their agreement. Once delivered, market surveillance authorities would base their risk assessment on this third laboratory test and possibly "harmonise" the risk management measures adopted against the product.
