A number of studies have recently been completed for the Commission which deal with different aspects of this issue and provide background information:

Unfair Commercial Practices - An analysis of the existing national laws on unfair commercial practices between business and consumers in the new Member States

Introduction

The Unfair Commercial Practices (UCP) Directive was adopted in May 2005. It will be applicable in the Member States by December 2007. These reports provide an analysis of the existing national rules, including case-law, on unfair commercial practices by business affecting consumers in the ten new Member States. They complement previous studies on national fairness laws in the European Union. The General Report contains an overview of the national regulatory frameworks on unfair commercial practices (e.g. general clauses, definitions, provisions on misleading advertising and aggressive practices). The National Reports provide more detailed information on the national laws as well as an overview of cases, decisions and codes of conduct.

Study on the Feasibility of a General Legislative Framework on Fair Trading by the Institut für Europäisches Wirtschafts- und Verbraucherrecht e.V. (November 2000).

This provides a comparative study of all Member States laws in this area including an examination of the US system and possible solutions for EU reform.
