Repeated renewal of EU product safety "emergency" measures causes legal uncertainty

Unequal implementation of EU product safety "emergency" measures by Member States distorts the level playing field

ENVISAGED ACTIONS

No measures at EU level

Extension of the period of validity of EU product safety "emergency" measures

To eliminate the confusion caused by repeated renewal, the Commission is considering two alternatives to tackle the problem. The first option is the extension of the period of validity of the EU product safety "emergency" measures from one year to two or three years. The second option is to make the validity of EU product safety "emergency" measures dependent on the occurrence of a certain event (such as the adoption of a European standard or a permanent EU legislative measure with respect to an identified risk). Whereas the first option offers only a partial remedy, the second would completely dissipate the concerns of stakeholders with respect to the period of validity of EU product safety "emergency" measures.
