  • Commission opens in-depth investigation into proposed acquisition of Cemex West by Holcim
    22 October 2013
    The Commission has opened an in-depth investigation to assess whether the planned acquisition of the German company Cemex West by its Swiss rival Holcim is in line with the EU Merger Regulation. Both companies are global suppliers of cement and other building materials. The Commission has concerns that the transaction may reduce competition in parts of Germany and Belgium where Cemex West is an actual or potential competitor of Holcim.

  • T-561/12 Beninca v Commission (access to documents)
    25 October 2013
    The GC ruled on an appeal against a Commission decision to reject a request for access to a document that was part of the Commission's file in its investigation of the merger between Deutsche Börse and NYSE Euronext. The GC dismissed the appeal and upheld the Commission's decision.

  • C-510/11 P Kone v Commission (lift cartel)
    24 October 2013
    The ECJ ruled on an appeal by Kone against a GC judgment of July 2011. The GC had upheld a Commission decision of February 2007 fining Kone, together with several other companies, for operating a cartel in the market for escalators and elevators. The ECJ dismissed the appeal and entirely upheld the Commission's 2007 decision.

  • Joined cases C-214/12 P, C-215/12 P, C-223/12 P Bank Burgenland and others v Commission (state aid)
    24 October 2013
    The ECJ ruled on appeals against a GC judgment of February 2012. The GC had upheld a Commission decision of April 2008 finding that the privatisation of Bank Burgenland involved incompatible state aid. The ECJ dismissed the appeals and upheld the Commission's decision.

  • C-77/12 P Deutsche Post v Commission (state aid)
    24 October 2013
    The ECJ ruled on an appeal against a GC judgment of December 2011. The GC had dismissed as inadmissible Deutsche Post's action for annulment of a Commission decision of 2007 extending the scope of a state aid investigation of Deutsche Post. The ECJ set aside the judgment of the GC, insofar as it found Deutsche Post's action inadmissible. The ECJ held that the Commission's 2007 decision was a challengeable act and has referred the case back to the GC to rule on the substance of the claim.

  • ECN publishes October 2013 issue of ECN Brief

    The European Competition Network, composed of the European Commission and Member States' competition authorities, has published the October issue of its news brief. Among other news, this issue reports on (i) new competition authorities in Spain and Belgium starting operations; (ii) the new UK competition authority launched in shadow form before going live in April 2014; (iii) the Latvian competition authority stepping up antitrust vigilance during the launch of the euro; (iv) a broad range of sector inquiries and decisions.
