  • C-544/09 Germany / Commission (DVB-T Berlin Brandenburg case)
    15 September 2011
    The Court of Justice ruled on an appeal against a General Court ruling of October 2009, that had confirmed a Commission decision of 2005 finding German support for the switchover to digital television in breach of EU state aid rules. The Court confirmed in particular that such support can only be granted in full respect of the principle of technological neutrality. Exceptions are only possible if a Member State proves that there are structural competition problems from the existing offers of other platforms.

  • T-216/06 Lucite / Commission (Methacrylates cartel)

    The General Court ruled on an appeal by Lucite against a Commission decision of 2006, fining several companies for operating a cartel in the methacrylates sector. The Court dismissed the appeal and upheld the Commission decision in its entirety.

  • T-234/07 Grolsch / Commission (Dutch Beer cartel)
    15 September
    The General Court ruled on an appeal by Grolsch against a Commission decision of April 2007 fining several companies for operating a cartel in the Dutch beer sector. The Court annulled the Commission's decision, finding in particular that the Commission had presented insufficient evidence to establish the direct participation of Grolsch, rather than its subsidiary Grolsche Bierbrouwerij Nederland.
