  • Joined cases C-322/07, C-327/07 and C-338/07 Koehler and others v Commission
    3 September 2009
    The Court of Justice ruled on an appeal by Bolloré, Koehler and Vizcaina de Papeles against a Court of First Instance ruling of 26 April 2007 (joined cases T-109/02, T-118/02, T-122/02, T-125/02, T-126/02, T-128/02, T-129/02, T-132/02 and T-136/02 Bolloré and others v Commission) that had upheld a Commission decision of 20 December 2001 finding a cartel in the carbonless paper sector and imposing fines on several companies. The Court confirmed the CFI ruling and the Commission decision with regard to Koehler and Vizcaina de Papeles. However, the Court annulled the Commission decision insofar as it concerned Bolloré. The Court considered that Bolloré's rights of defence had been infringed in holding it liable for its direct involvement in the cartel as well as for its involvement as the parent company of Copigraph, but only including the latter ground in the statement of objections.
  • C-534/07 Prym v Commission
    3 September 2009
    The Court of Justice ruled on an appel by Prym against a Court of First Instance judgment of 12 September 2007 (case T-30/05) that had upheld a Commission decision of 26 October 2004 finding a cartel in the needles sector and imposing fines. The Court entirely confirmed the CFI ruling and dismissed all of Prym's grounds for appeal.
