Revision of the 2001 notice (2007)
The remedies notice provides guidance to companies on modifications to their proposed transactions ("remedies") to eliminate competition concerns identified by the Commission. The draft revised notice was open to comments from the public between 24 April and 27 June 2007. The proposed amendments included an adaptation of the Merger Implementing Regulation (Commission Regulation (EC) No 802/2004), namely a new "Form RM" to submit remedies proposals to the Commission.
The revision followed an extensive study by the Commission about the implementation and effectiveness of remedies recent judgements of the European Courts and the new Merger Regulation in force since 2004.
