All citizens and organisations are welcome to contribute to this consultation. Contributions are particularly sought from public service providers and their associations, public service users and their associations, local and regional authorities.

Objective of consultation

The Commission's policy on the application of State aid rules to services of general economic interest (SGEI) aims at ensuring the smooth functioning of the internal market, by ensuring a level playing field between SGEI providers, while at the same time safeguarding the general interest, in particular the satisfaction of citizens' essential needs. Pursuant to these rules, public service providers can receive compensation to cover all of their net costs in the provision of SGEI, possibly including a reasonable profit.

In its judgment in the Altmark case, the European Court of Justice held that public service compensation does not constitute State aid within the meaning of Article 87(1) of the EC Treaty [now Article 107(1) of the Treaty on the Functioning of the European Union] provided that four cumulative conditions are met. However, where at least one of the Altmark conditions is not met, and the other State aid criteria are also present, the public service compensation at stake constitutes State aid.

On the basis of this case law, the Commission adopted in July 2005 the "SGEI Package" in order to define the conditions under which State aid in the form of public service compensation can be considered compatible. The "SGEI Package" includes:

In addition, to clarify the issues related to the application of EU rules to SGEI, the Commission services issued two staff working documents in November 2007:

As a follow up to this, the Commission services launched in January 2008 an Internet-based Interactive Information Service allowing stakeholders, public authorities and citizens to ask questions on the application of EU rules to SGEIs and to receive prompt answers.

Both the Decision and the Framework foresee an evaluation report to be undertaken by the Commission. This evaluation report is to be based on factual information and the results of wide consultations conducted by the Commission on the basis, notably, of the reports provided by Member States on the implementation of the Decision.

The Commission received reports or information letters from the Member States on the implementation of the Decision in the course of 2009. These reports are available on DG Competition’s website.

The Commission now wishes to consult public service providers and their associations, public service users and their associations, stakeholders, citizens and all interested parties, in order to have their views on the application of the SGEI Package.

For this purpose, the Commission has prepared the present questionnaire, to give guidance on the feedback it wishes to have through this consultation. The questionnaire comprises several sections and contains questions drafted as to invite as many answers and comments as possible. Please respond to the questions you consider as most appropriate to your field of expertise and your knowledge. We welcome any further information that you would consider useful for the evaluation report of the Decision and the Framework.

Results of the consultation and next steps

Following the consultation, the revision process for the SGEI package consisted in the preparation of draft texts that were submitted to a second round of consultation in September 2011.
